Fitrzgerald is not concerned with the substance of the issue. His focus is on the intent Scooter had when testifying to the FBI. The Scooter is hot water aplenty on that legal issue. He walked into a well-planned perjury trap and took the bait.
There is a recent case where a wedding photo of two "Oregon" gay men was used in an ad in USA Next, apparently an anti-Dem ad.
