A furious debate has erupted after a court threw out charges against an Indiana driver who repeatedly shot one motorist and injured another in a near-deadly road rage incident in the middle of Fort Wayne.
Shocking dashcam video caught the moment a van driven by Jason Henkle, 42, veers from the middle to the inside lane clipping a sedan being driven by Alexander Mozee, 19.
Seconds later Mozee accelerates and stops in front, bringing Henkle's van to a halt as traffic lights turn to red on Maplecrest Road.
The teenager springs out of his car, followed by his passenger, and swings at Henkle's driving seat window, shattering the glass as he punches straight through it.
Henkle reaches for his Ruger .380 handgun, hitting Mozee twice and showering glass over another motorist whose window was smashed by a stray bullet.
Mozee was not seriously injured and Henkle was arrested on charges of criminal recklessness with a deadly weapon, while Mozee was charged with battery.
Mozee was struck in the arm and the shoulder, and can be seen stumbling away clutching his hand.
Henkle told police he fired three shots to protect himself and his wife after Mozee punched him in the side of the head with the same swing that shattered his window.
Mozee has a court date pending but Henkle's charges were dismissed by Allen Superior Court

Road rage seems to be all the rage these days.
Makes perfect sense to me. Also, a .380 in the hand beats a .45 you left at home.
He had EVERY right to shoot him! If you get some punk willing to punch your window out, then you must assume he is looking to cause you physical harm as well. You HAVE to shoot him because you only get ONE chance!
What if he said “Oh I won’t shoot him after he punched my window out because I can tell he’s a nice boy” and then the nice boy takes out a knife and plunges it into the guys throat, or he pulls out a gun and shoots him through the window?
You only get one chance to protect your life and I’m suppose to gamble that I won’t get severely injured or killed? Screw that. Someone does that crap to me they are getting popped.
Reminds me of a video I saw a few years ago, this guy on a motorcycle went road rage on a guy in a car. The motorcycle guy gets off his bike in stopped traffic, pulls out a gun and threatens to shoot the car driver. Well then the car driver pulls out his own gun and shot the bike rider dead. He HAD to do it, why should he gamble his life?
No problem, Jason Henkle, 42 is cited for an unsafe lane change, pays for any damage to the other car('s), and is required to complete and pass firearms safety training.
Alexander Mozee, 19 is arrested, prosecuted and convicted on three counts of attempted murder, assault, battery and multiple counts of reckless endangerment. At sentencing, Mozee's sentence is enhanced by the number of convictions and arrests on his record.
He should get about 30 years before eligibility for parole.
I have the Ruger LCP .380 6+1 & love that it fits in my pocket. Thinking of upgrading to the S&W Bodyguard with laser since it has a thumb safety. The LCP doesn’t have a safety so I don’t have a round chambered which concerns me.

It is obvious that Mozee punched out Henkle’s window just so he could tell him that he was going to call the cops and report the accident so Henkle could be punished for an improper lane change.

My deduction: You would have rolled down your window to be sure you got the message.
Completely justified shoot.
I would never have made an unsafe lane change and struck Mozee's vehicle.
Indeed Mozee would break my rolled up window in an attempted murder.
I would defend myself, my passengers, my video cameras, without endangering bystanders and there would be no possibility to prosecute Mozee.
He would accept the outcome in silence, and never bother anyone again.

Obviously from his reply to me, his earlier was in jest...humor through sarcasm.
So I owe him an apology.
Second, I have been close friends with some real WWII war heros...not self described, but documented and their actions were as heroic as any wild movie plot you hve ever seen.
But that still does not give any of them a blank check.
And for the record: One of them flew the P-51 and got his picture on Time Magazine cover for landing on a German grass field, picking up his wing man who had been shot down...an impossible feat, but he did it.

Another flew for the Chinese before Pearl Harbor and quit after that and flew fighters in the Marines.
Another was shot down in his B-17 and came back from a German prison camp weighing , I forgot exactly, but something like 120 lbs...grey headed at 20 something years old.
Another flew B-24s off of England.
Another was a tail gunner on B-7’s. a very dangerous position.
A neighbor shot down piloting a B-17 and never accounted for.
And our attorney for years piloted a B-24 based in England.
My list is quite a bit longer, but enough is enough.
I learned a lot from them and am more than grateful.
All but two are now dead and I lost contact with them.
But everyone my age that I knew is now gone.
The “innocent bystander” could have been grazed by a bullet that went through the perp—or missed completely—and struck some part of his own car and ricocheted.
The perp wasn’t “blown back” by the wounding bullet, but instinctively tried to get away. The perp’s passenger looks perplexed, probably re-thinking his initial support for the perp.
I, too, have that. The LCP II can fit an after market laser, but not the original. Very disappointing. I do like its small size, though.
Fort Wayne is the armpit of Indiana.
