The Pentagon said that because the author is a retired service member, any potential criminal prosecution would be handled by the Department of Justice.

A few editorials to some major newspapers regarding investigating obama’s leaks would be a good thing. After all, when the COMMANDER IN CHIEF LEAKS INFORMATION he absolutely betrays his oath of office.
I Don't think he's in any trouble. I do think the Pentagon is being pushed to do it, and cooperating because they know there is nothing that would damage national security.
The only damage is to personal security, the risk is to the holders of office who violated laws, treaties, lied to the public.

He signed a nondisclosure agreement. Does he or his attorney get to decide what he should or should not disclose? Is that in his agreement?
They certainly get to decide what is and isn't covered by the agreement based on its plain terms.
