I've seen arguments with regard to original intent being divined from the Declaration. Those arguments stand in contrast to the absence of any federal legislation in the early years, when the Founders and the people who were involved in the drafting and ratification of the Constitution were in power.

I struggle with the proposition that we're going to enact legislation according to the original intent of the Founders that they themselves did not enact when they were in power.

I have no doubt the Founders would be aghast at a future court finding a right to kill a baby in their meticulously argued Constitution.
