If Beatrix Lestrange and Voldemort were killed while the cup was still at Gringotts, it should have been possible for the Ministry to destroy it afterward I would think. Voldemort couldn't be killed as long as the hufflepuff cup was intact..It was a horcrux, and that bit of his soul that was in it would've prevented his death.

I was in the grocery store tonight and had to laugh at the conversation between two clerks. One yelled across the aisle to the other, "Does Harry Potter die? No, don't tell me, I'm going to read the book." The other said, "I'd like to know, who knows if he dies or not?" And I walking by said, "You really want to be spoiled? Harry doesn't die." And she was so relieved, hehehe.
