If I look out the window and then post, "It's night time," that's not an opinion, it's a statement of fact.

Not really. On the internet --- it is not night when you say it is night if I'm sitting in Australia and it's day time for me. Same with seasons. You might say it's autumn but it's spring if I'm in Australia. So that's not a fact. Again ---- what about those people who claim OJ Simpson harmed or wished to harm Nicole? He was proven innocent by the jury.

OK, let me rephrase it:

If I post, "It's night time out where I am," then it's a statement. It may or may not be true. In this case, it is.

"Again ---- what about those people who claim OJ Simpson harmed or wished to harm Nicole? He was proven innocent by the jury."

Issues:

1. The jury didn't "prove him innocent." They simply refused to convict.

2. The civil suit found that the preponderance of the evidence pointed to OJ as the killer.

3. He is, by nature of his celebrity on the gridiron and appearing in really awful movies, a public person.
