I wasn't able to get to Dover the day of his hearing, but got a blow-by-blow detailed description of what occurred later that eveing.
When the enforcement agent stated, under oath, he couldn't tell if what was being smoked was actually a tobacco cigarette, Frank immediately asked for a dismissal - which was denied.
The entire enforcement and fining with this ban is a complete and total FARCE - there is absolutely no due process. The department doesn't have to PROVE anything, the establishment owner is the one that has to do the proving. A perfect example of guilty until proven innocent.

The dumbass mayor of San Antonio was trying to push a smoking ban in the downtown tourist area awhile back, but suddenly the idea wasn't so important to him. One of the news stations had a straw poll that showed 70% of the business owners and patrons against it. Most people there are more concerned over the ever-increasing exodus of businesses (and customers) from downtown to the suburbs to go throwing gas on the fire (pun intended) by banning smoking. Their mayor lives in lala land anyway-I've known him for a number of years and he has always seemed totally unrealistic to me. Another damn good reason why we moved from there.
