I think executive privilege was the wrong legal argument; the argument should have been the legal procedural errors in the trial that in practical terms denied Trump due process; demanding a new trial and a change of venue out of NYC.

I agree. Executive privilege is pretty much only applicable with he was in office. I wonder if he can file another appeal.
