"Why don’t they just seize property under eminent domain?"

I believe those have to come before Judicial review. As the Judiciary, on so many levels is rife with TDS, I doubt he would get a favorable outcome.

Eminent Domain could be used if there were an unwilling seller. Sounds like the owner is (probably more than) willing, which is a Good Thing. (Also, just compensation would be due the owner, regardless...)
