I am not saying that. He spoke Spanish— to the police. Why would he assume they would understand Spanish ? And he pleaded with them. As I recall, the girl said he said “please”... it just seems an odd thing to say at that moment. I would say “I give up.” Surely he knew at that moment that his life was hanging by a thread.

Their mayor has really ripped the immigration policy, saying his town has been flooded by the illegals.
Spanish may have been the shooter’s first language, in stressful situations, people often revert to their first language.
