The military is under civilian control. AFAIK, civilians aren’t subject to military tribunals except in very limited circumstances.
Like the four executed on July 7, 1865 following conviction by a military court for their role in the conspiracy to kill President Lincoln?

That’s one of the limited circumstances. DC was argued to still be a war zone since there were still Confederate troops fighting, so the assassination was an act of war.
And it was controversial at the time..
