Great business advice re: mandated mask wearing

Update regarding wearing a mask or not wearing a mask in our facility.

Those in our government have ordered all persons entering indoor facilities to wear a mask.

If you have a medical condition that prevents you from wearing a mask you are exempt from this order. Due to HIPAA and the fourth amendment we cannot legally ask you about your medical condition.

Therefore, if we see without a mask, we will assume you have a medical condition and we will welcome you inside to support our business thank you.

HIPAA applies to physicians etc. to protect patients.
4th Amendment applies to government.

Better argument is ADA or state equivalent laws.

Also many of the exec orders contain a medical exception where wearing a mask creates a greater danger than not wearing one. Plenty to work with there...asthma, dizziness due to carbon dioxide increase, fear of masks (a legit phobia), etc.

It goes further than that. If you work for a company and have a need for some level of access to private information (ex. processing a short term disability request) you cannot disclose the information. There is no need to share such information with anyone unless there is a truly compelling need.

A Kroger employee told me that the company told him if he couldn’t wear a mask because of a medical condition, he would not be allowed to work - no job.

I suspect they could be on thin legal ice, but they know well that the employees don’t have the financial resources to challenge the company.

I have had a couple of people working in retail stores that told me they had asthma and were having a very difficult time working with masks on.

The reality is that while it likely does nothing good for you, these masks won’t hurt you for 20 minutes in the grocery store. Wearing one for an 8 hour shift is a very different matter.

This is why Walmart pressured AsaHutchinson to do a mandate. They did not want to lose sales to small businesses that did not require them.

I have an unusually low pulse and IMO sucking in less oxygen and more co2 is bad. It’s bad for anyone, but with the low pulse rate I have a good claim. Plus I am just a dick who doesn’t like this crap. Especially coming from a real ahole like Andy Beshear.

BTW, they are already making noises about the coming flu season being devastating so I figure if the Chun King Flu lets up too much, they will start this fascist crackdown all over again for it. They are not letting this go. Ever. Unless the people in mass ignore the orders. Which they have clearly demonstrated they will not do.

If you have an near-asthmatic condition, and you have just walked across a large parking lot in 115 degree AZ heat, and then you have to wear a mask in the store (where a family shopping run is more like 35 minutes depending on queue at checkout), it can make a huge difference. Someone close to me needs nearly a full day to recover from such.

Regardless, COVID ain't Ebola, and it is going to get who it is going to get. This Kabuki theatre just invites more of the same, like TSA, only EVERYwhere.

Agreed that HIPAA is broad. Many protections for personal health info stored/possessed by third parties is actually covered by the HITECH Act (which complements HIPAA) and many state data privacy protection laws, regs, and rules too.

I’m living and working in Santa Clara County, CA, where everyone is required to mask up. I have posted signs that note the requirements, but in the end I have only limited powers to enforce it.

I ain’t a cop, and if one of our customers doesn’t want to put on a mask, I won’t force the issue.

JOHN BERMAN, CNN ANCHOR: Dr. Wilson, I’m a parent of two 13-year-old boys. Alisyn has school-aged kids, as well. There was a study out of South Korea. This is a backwards-looking study at the infections in South Korea among younger people. And what it found, looking at thousands of cases, was that the infection rate among kids, middle-school age and older, you know, 10 to 16 or so, was about equal to that of adults.
In other words, students passed the virus just as much as adults do, and children younger than 10, a much lower rate. But not zero. About half or 40 percent of the rate.
I was surprised to see this, based on some of the things we’ve been hearing in the United States over the last few weeks. What are the implications of this as we plan on opening schools?...

DR. JASON WILSON, ASSOCIATE DIRECTOR OF EMERGENCY MEDICINE, TAMPA GENERAL HOSPITAL: And that’s the big conversation right now in Hillsborough County. You know, we were supposed to go back to school on August 10. That’s been delayed now until at least August 24...
So far, what we’ve seen here, in this area, and it may be different in South Korea, we don’t know, but what we’ve seen here is we have not seen a lot of spread from kids to adults. We’re not seeing that too much yet.
We certainly see high rates right now. I think we saw some record- breaking rates over these past seven dates for our children, for their positivity rates, but again, very few of those have to be hospitalized, thank goodness...

My response has been to order only necessities like groceries and to do that online for delivery or pickup. If enough people did the same thing, retailers would be screaming at our rulers to end the mandates. The big box chains are often heavily leveraged, and a “buycott” would put them in jeopardy. The retail giants have more clout than the subjects of petty tyrants like Newsom, Cuomo, Wittmer, and Abbott.
