Looking for lawfags to answer a question.

If the EO for military tribunals doesn’t take effect until Jan 1, can it be used to proceed against anyone arrested between now and then?

Is there a process for a Grand Jury to refer a matter to a specific court? Or does the grand jury just tell the DA/Prosecutor there is sufficient evidence go do your thing?

Not sure when the venue for the trial is selected but I would guess that is the specific trigger point on when the EO would need to be in place.

as I recall the EO was structured to say that it could be activated by Sec of State or Sec of DEF and that if not activated before January (19th?) then it would kick in automatically.
