An Alabama man who struck and fatally injured a 75-year-old New Orleans attorney with his car last summer outside a wedding pleaded guilty to vehicular homicide Thursday (June 9).
Chester "Theo" Alpaugh, a 35-year-old from Vestavia Hills, Ala., expressed remorse for causing the death of Robert Henry Sarpy in a letter defense attorney Bruce Whittaker read in court to Sarpy's four adult children.
"None of you realize how sorry I am and how bad I feel," Alpaugh wrote. "If I had the power to change things, I would. I did not want this to happen. I did not want to harm Mr. Sarpy. ... I hope that one day you will have it in your hearts to forgive me, but I will understand if you cannot."
Alpaugh pleaded guilty as part of a plea agreement that saw prosecutors amend a charge of second-degree murder, for which he might have received a life sentence.
Criminal District Judge Franz Zibilich approved the deal, and sentenced Alpaugh to 30 years in prison, with 17½ years suspended, followed by five years of active probation and a $3,000 fine. Alpaugh, who has been evaluated for possible mental illness, was ordered to live in a group home and is banned from operating any type of motor vehicle during his probation.
Alpaugh has been jailed nearly a year in lieu of a $150,000 bond and will be credited with time served. He must serve the first three years of his sentence at hard labor without the benefit of parole eligibility.
After that, he could be eligible for good time credit and parole consideration during the remainder of his 12½-year term. The offense is not considered a crime of violence, so there is a chance Alpaugh could be paroled after serving as little as 36 percent of his prison

Well, he ought to be able to lose about 300 pounds whilst incarcerated. That’s a bright spot........
30 years? Must be an American citizen.
He’ll especially enjoy it if he gets a job in the prison’s kitchen.
If the Blueberry Girl in the Willie Wonka movie did the ‘dance with no pants’ with an Oompa Loompa, this could very well be the outcome.
