The SCOTUS’s term ends in June. The Senate will not confirm before then and they will not confirm in October when the SCOTUS’s new term begins in the middle of the election.
They should refuse to approve Obama’s appointee, no matter what. If the Democrat wins in November, they can vote at that point. Obama gets the appointment that way, not the new democrat President. The game is over if a Democrat wins, anyway. But if the Republican wins, then no dice.
