Maybe. But this kid is now facing much more serious charges. He made the absolutely worst decision he could have made in this situation, and his life is now essentially over.
The school should have focused more on discipline, the victim shouldn't have been such an annoying prick. But, at the end of the day, all of that is secondary and the blame here falls fully on the shooter.
