Yes. You are absolutely correct in theory. But you must factor in the fact that, when under stress, people often do irrational things.

Read up on the Daniel Shaver case. That poor guy was on his belly crying and begging for his life. He went to hike up his pants and the police shot him to death.

There are, of course, also many sad examples of criminals killing police officers. All I’m saying here is this: the phrase “just obey the police” is easier said than done when you’re under great stress. Scratch an itch on your leg and you could get shot to death. It just ain’t right.

I see a stark difference between the Daniel Shaver case and this. Daniel was fearfully complying and was in an already weak position being on his hands and knees. This guy wasn’t complying at all, ignored all orders and reached for something in his car. This wasn’t an “I’m frozen in fear” (non-compliance) or a I’m complying but moved my arm wrong. This was a blatant disregard for the officers orders, once guns are drawn you’re going to lose - this guy pushed it.

...not even close imo.
