Yes he is smart enough, the Rats have something on him and he will dance to whatever strings they pull. In my book he is to be trusted about as much as Chris Matthews and Matthews' sometimes girlfriend Keith Olbermann.
In fact he's probably more dangerous because a lot of folk think of him as a conservative and straight shooter.

His way out is the slim possibility of a Pardon by new President Biden..if Obie goes sideways thats out the door..I wonder what a psychologist/psychiatrist would say? Most people like him seem to go down hard when the party is over.

Obama’s executive Order would trump FOIA. But Obama will not be able to hide them from Court ordered Discovery without declaring them part of National security and even then probably not.

There is no burden of proof on Obama at this point. He doesn’t have to produce any documentation until the discovery process actually begins.

Obama and the defense can ignore Carter's words at their on peril. His words are unequivocal. He explicitly puts the burden on Obama to cooperate:

Carter repeated said he was eager to get the matter settled.

“If President Obama fits the qualifications under the rules of the court, the longer the delay the more credibility it lends to the complaint,” he said. “If President Obama does not meet the court’s requirements, the delay also causes a problem.”

Discovery is suppose to be a cooperation between attorneys no hearing is necessary. If one side or the other refuses to cooperate there is a hearing on compelling them, or excusing them, or sanctioning them.

That is my understanding of "discovery" as well.

Yeah she needs to win the war not this minor battle. Stubborn. Does she want all the glory. I don’t know? The judge already told her she could appeal his telling them to work together if she liked, but if I were here I would shut up and if she lost the whole case make it part of the appeal..JMHO. Know when to hold em know when to fold em.

Yes, I read all of that too. My point is that Orly filed a motion for expedited discovery. Judge Carter hasn’t yet ruled on that motion. Until he does, the defense isn’t required to sit for depositions or produce any documentation. By “encouraging early discovery,” Judge Carter is telling the attorneys to be prepared for early discovery.

I see your point. And if we were dealing with a teenage child having made a grandiose mistake where the possibility of reformation still existed, I would agree with you completely. But we are not dealing with a child, but a man. We are not dealing with a mistake, but treason. There is no "out" we can offer him that does not compromise the integrity of the very document he took an oath to uphold. He knew there was a point of no-return and the danger of the path he chose, and he signed his own name to it. If you have an idea for an "out" to hand him, I'm all ears. I just don't see one myself.

Orly is fighting against Obama or his attorneys. She also wants to fight against Kreep and then the Judge. Bad bad move. You always want to stay on the Judge’s good side and this will just irritate and anger him.

If she blows this case by continued infighting with Kreep then I will bash her here daily. She could win this but she needs to back off on the Kreep batle.

I hope that a group of Native Born Attorneys will step up to the plate and give Ms. Taitz some assistance on this. The other side has a huge team of taxpayer funded Justice Department lawyers along with Obama and DNC funded attorneys. This is not a fair fight. One would think some patriotic PR people might step forward also. This truly is a David vs. Goliath struggle. I may be dating myself here but this also reminds me of the “Ant can’t move a rubber tree plant” song by Doris Day. Does it take someone who escaped from a failed communist state to throw themselves into this kind of battle?

Unfortunately, I have had some negative experiences with the legal system. When the side with unlimited resources loses, it truly is a miracle. That is what I am hoping and praying for here. What a spectacle… this courageous little lady taking on the most powerful man in the world and a legion of unscrupulous mercenary attorneys. Almost all of whom must know that there is no legitimate reason for Obama to hide all of his records. If this traitorous fraud is finally exposed I wish that the guilty parties and their co-conspirators will somehow be sentenced to the same fate as Benito Mussolini.
