So we could get a McCain/Biden ticket? (sounds like a dream ticket for McAmnesty actually).

I don’t get why Biden wouldn’t just become president. If this was done after they were sworn in, would Biden become the president then?

If Obama is disqualified PRIOR to Electoral College selection, there would be only 2 remedies:

1. Order a new election with certified candidates (oy vey!).

or

2. Award the election to the qualified candidate with the second most votes (McCain)

Biden MIGHT be able to make the case that his election was valid (if so, he would be VP). If SCOTUS invalidated the entire Obama/Biden ticket, Palin would be VP (second most votes for VP).

If Obama is disqualified AFTER Electoral College Amendment, the VP-Elect (Biden) would become acting POTUS on Jan. 20th until a new POTUS has qualified (20th Amendment). Barring a new election, it would likely be McCain as POTUS. Biden MIGHT be VP, if SCOTUS ruled his election valid - if not, Palin would be VP.

If Obama is disqualified AFTER inauguration, Biden would be POTUS (25th Amendment) and would presumably nominate a new VP (with Senate confirmation). However, McCain COULD sue and probably prevail based upon the election being based on the perpetration of a fraud. Biden MIGHT be VP, as above, if not - then Palin. Or, a new election could be mandated.

Its a friggin’ mess !!!
