Amusement Park Responsible for Injuries to Obese Patron

On March 12, 2004, a New York jury found Six Flags Darien Lake liable for injuries sustained by a 395-pound man when he was ejected from the Superman – Ride of Steel coaster in May 1999. The jury awarded $3.7 million in damages to the plaintiff, Michael Dwaileebe, and $250,000 to his spouse. Although the jury assigned 10% of the negligence to the ride manufacturer, Switzerland-based Intamin AG, it also found that the manufacturer’s negligence was not a proximate cause of the accident.

According to Dwaileebe, the T-bar lap restraint did not close sufficiently due to his size, resulting in his being ejected when the roller coaster traveled through a “camel hump” hill. The amusement park claimed that the manufacturer should have used a different lap bar configuration, and should have provided better training to the park employees, but the jury apparently accepted the manufacturer’s position that the restraint was properly designed, and that it had provided adequate training and documentation to the park employees.

Bingo. You could even look at film taken at Disneyland in the 1950s, and then go yourself today. I've never seen images of fat people in the past in any number that rival what you could see today at any given all-you-can-eat buffett.

fat people are abusing their bodies the same way someone smoking crack or shooting heroin is, if you want to see gross examples of obesity and gluttony go to the cheapest buffet in town and watch what waddles up, these are the same people that go around saying “I don’t know why I am so fat I really don’t eat that much”

I stood up for my countrymen when this stuff started, then I went to Seaworld. Good God man!Give me a freaking break people! Now the number of women I see obese is crazy. It used to be the man had a belly and if the woman was big at all she may have had large hips. Now I see so many women who are borderline shut- ins.

Walmart and amusement parks indeed! I am thinking of going to Schlitterbahn this year but the scenery could be brutal. Might be too many whales.

- Bingo.
I have noticed that, for some reason, women seem to be especially susceptible to being seriously overweight. Maybe it’s just their choice in clothing which seems to emphasize form hugging pants, but the percentage of women waddling around shopping malls seems to be unusually high.
Especially disturbing are the programs on TV, many of which feature college age girls, many of whom seem unaware that they are already “heavy set” at an age when obesity shouldn't’t even begin to appear - except for those who overeat for emotional reasons.
However, I have noticed this does not seem to be a particularly American problem. There are now many home buying/selling and home improvement shows showing up on television in the past year from the UK and I am always amazed over the number of housewives on these shows who are seriously obese - many are built like little barrels. Maybe it’s all those fish and chips washed down with frequent visits to the local pub that’s doing it, but it’s truly surprising to see.

In Wal-Mart they tend to ride around on those carts. It makes me sick to see younger people who are fat park in a standard/non handicapped parking place, walk inside without any problems, and get on one of those carts because they are just flat out too lazy to walk. The other day I saw a fat husband and wife both riding on them, with each of their carts full of junk food.

I've always wanted to catch one of those people and pull the cable on the battery when they aren't looking. I wonder if they would get off of the cart and walk away, or call out for help because they are stranded. lol
