Mayor Bloomberg's attempt to prohibit certain large sugary drinks from being sold by certain city purveyors was dealt a blow this morning when an appellate court upheld a previous decision — by a judge named Milton Tingling, you may recall — striking down the ban. Both Bloomberg and Health Commissioner Thomas Farley had said in May they were "confident" that Tingling's ruling would be overturned. The case can still be appealed to the Court of Appeals, the state's highest court. A new proposal would require New York City retailers to keep tobacco products out of sight under a first-in-the-nation proposal aimed at reducing the youth smoking rate, Mayor Michael Bloomberg said Monday. The legislation would require stores to keep tobacco products in cabinets, drawers, under the counter, behind a curtain or in other concealed spots. They could only be visible when an adult is making a purchase or during restocking. "Such displays suggest that smoking is a normal activity," Bloomberg said. "And they invite young people to experiment with tobacco."
