This needs to be strongly tied to the pending administration of DemocratCare by the IRS. Health care shouldn't be politicized, nor should medical care be turned over to lying, bureaucratic partisans.

The issue opens up many possibilities, but the first priority must be winning the Senate back and strengthening the House majority. What Boehner and Mitchell need is another Contrat with America founded on transparency and small government. People want their privacy back and we can lever that into a demand for liberty. The law, at the levels we have now, is obscene and no longer reflects reality. It is a monster used simply to plunder a la Bastiat.

Now's the time for a real reform of the tax code. There are worse scandals, but this one is virulent. We need to use it to capture the mushy middle. Now isn't the time for the GOPe to be in the ascendancy, but conservatism, good old conservatism (not that neo-conservative garbage).

It strikes right at the heart of religious liberty, the Founding of America, the Constitution and specifically the 1st Amendment. If government can control thought then all is lost.

Every liberal ideologue who claims persecution for some petty purpose - a cross at a graduation, the right to kill your baby, etc. - simply undermines the sharp distinction between public and private and makes a mockery of liberty. Roe v. Wade is an especially noxious curse in that it forced conservatives into the absurd position of stating that the Constitution doesn’t guarantee a right to privacy. Of course it does. Yet, no one has a right to a private murder.

Between the Scylla and Charybdis of liberal mockery and conservative abandonment we’ve arrived here. The entire US Constitution exists to tell government - leave me alone. What could be more inherent than a right to privacy, to ones private thoughts?

Wouldn’t insurance contracts, torts, and a compliance framework function better than government in this area? My concern is that once government starts regulating it just can’t stop.

SCUBA diving is largely unregulated and risky, but commercial interest - you don’t want your customers dying - and lawsuits combined with insurance regs and privately set standards keep it safe. Self-regulation can work, given the correct incentives, transparency and tort law.
