SAN FRANCISCO -- A federal appeals court late Friday nullified a federal judge's ruling that took Oregon coastal coho salmon off the threatened species list.

The two-sentence decision from the 9th U.S. Circuit Court of Appeals stops any logging along the salmon's habitat that was authorized under U.S. District Judge Michael Hogan's ruling in September. The circuit's decision will remain in place until it makes a final ruling, which could be months or years.

"The logging will now stop," said Patti Goldman, an attorney with the environmental group Earthjustice in Seattle.

Hogan issued the delisting order in September after concluding that it made no sense for the government to declare wild coho salmon threatened under the Endangered Species Act while not granting the same status to hatchery-born salmon. Environmentalists appealed.

After Hogan's ruling and decision against an appeal, the National Marine Fisheries Service said it would review whether 23 of the 25 groups of Pacific salmon and steelhead protected under the Endangered Species Act should keep their listings.

The fisheries service said it would also review the role hatcheries play in restoring dwindling salmon populations. Current federal policy considers hatchery fish a threat to the survival of wild fish because they compete for limited food and habitat, carry disease, and are less successful at survival in the wild.

Environmentalists appealed.

It is long past time that these watermelon organizations be refused 'standing' to foist their criminal views on the owners of the properties and the rights appurtenant thereto.

Man, that's disgusting!

We need a lot more accountability for these judges- like having them run for office, or subjecting them to periodic review.

The difference is as clear as night and day. The funding of hatcheries is based on a commercial or if publicly funded , a public use interest. Absent the right to "harvest" the fruits of the effort, the incentive to subsidize this publicly or commercially dries up. But of course these leftists can't see subtle distinctions like return on investment.

The 9th Circuit covers California, Oregon, Washington, Arizona, Montana, Idaho, Nevada, Alaska, Hawaii, Guam, & the Marianas. It is the most liberal court in the US.

I said that this was going to happen when Judge Hogan's decision came out. There will be more. If they don't overturn it all, they will simply erode it. Earthjustice has VERY deep pockets. Here is what I cited from my book on this thread as the reason for their legal power and how to mount a proper response. Frankly, I am rather disgusted, because I got but one response.

If you will note, George, that post states how to solve the problem of "standing."

They're having record runs of hatchery salmon returning from "the wild" every year. It appears they survive just fine out there.

I know. It's the people who prefer to fuss and fume than do something that drive me to distraction. Even worse in some respects are those who make a good living off the struggle and subconsciously fear a solution or are so embittered that they can't see anything new. They exist.

Why do you think Clinton/Gore spent so much time during the last elections out here? I live in the area and the Sierra Club is big and powerful, and exactly where socialism has found a home. Everything they do should be watched carefully, and the judges they pay also.

Here's my "take" on the whole rotten mess!

Carry_Okie is correctamundo to the max!!! The sooner conservatives pick up his constitutionally correct and inspiring concept, the better off the USA, even the world will be. Everyone needs to get his book, read it twice, learn it, love it and promote the positive ideas contained therein, till we get somewhere much better than we are!!!
