Man with unlicensed gun fatally shoots armed intruder

NEW YORK (AP) -- A Queens man shot to death an armed man who allegedly broke into his apartment on Tuesday night, police said.

The intruder, who was in his 30's, forcibly entered the Elmhurst apartment just before 7 p.m. and was confronted by a 22-year-old man and a 20-year-old woman, said Detective Carolyn Chew, a police spokeswoman.

The male resident then shot the intruder with his own unlicensed handgun, police said.

Neither of the residents was harmed. Police did not release the identities of the apartment's residents, and the victim's identity was not immediately known.

No charges have been filed.

Yup... lots of New Yorkers don't obey the Sullivan Law. If they did they'd be dead. Let's see if the D.A files charges for illegal gun possession.

Another proper use of weapons that will quietly go into the history books while New Yorks scum of the earth in the us senate use their God given rights, enumerated in the Constitution of the United States of America, to attempt at every turn, to destroy other rights enumerated in the Constitution of the United States of America. Surely New York could be taken over by the wise, the just, and noble. In a pigs eye.

I'd be more worried about the civil suit that will inevitably be filed. The perp, who has probably been a worhtless use of human skin for his entire life, suddenly becomes very valuable dead.(at least to his 3 or 4 ex'es and 6 illegitimate rugrats)

Or maybe that should read, "must prosecute" to keep his job, even though the case is a no-win for the DA.

You're not considering the adverse socio-economic effects that unregistered firearms, in the hands of citizens that know how and are willing to use them, will have.

This criminal and others may have paid someone good money for a list of all the registered gun owners in a certain area. What happens, if more and more criminals discover that those lists aren't accurate this same way?

Who's going to support their families?

Who's going to buy the drugs they used to buy?

Who's going commit all the crime they used to commit?

The next thing you know a criminal will go to a residence that the list says contains guns and there won't be any guns there.

I thought a license was needed only to carry it concealed. A firearm doesn't need to be licensed if you keep it in the privacy of your home, does it?

There are not many wise, just or noble here, as confirmed by our last Senate race. "In Hillary's eye" would be more fitting.

In New York (and some other states in the NE and Midwest) one must have a license simply to OWN a firearm, much less carry it (concealed or otherwise).

Imposing that restriction on ALL gun owners is the near-term plan of the anti-gunners, with the eventual goal of completely eliminating firearms ownership by the lawful citizen.

if I gunned down an intruder in one of these fascist regions of the nation, I doubt I would even report it. who is going to miss a theif? like his family will say..."Well, he stepped out last night to do some stealing. Lets look at who he had penciled in on his day planner."

dump him in an abandoned lot and go out for a burger.

Oh, its not a no-win for the DA. Since it is illegal to even OWN an "unregistered firearm" in NYC, it is an automatic win--no matter if the firearm was used for a lawful purpose or not.

A near-term goal of the anti-gunners is to make "self-defense" an "unreasonable purpose" for owning a firearm. Once that is accomplished, they'll go after sporting weapons, and finally ban gun ownership by ANYONE, while allowing firearms use only by "...police and the military...".

I suppose if he is going to pin a career on this case, then he needs to be on the "watch" list to see how he does in the next twenty years. Maybe he will be after mr shumer's seat, but by then reality will have set in and new york will have rediscovered it's constitutional roots. Sarcasm off.

Thanks for that information. Here in Pennsylvania the law doesn't work like that. It doesn't matter, though, because I have a license to carry (and do!).

What if the shooter had said "the intruder dropped HIS gun, so I picked it up and shot him"? Or better yet, "the intruder broke into our Safe Room, called me the "n" word, dropped his gun..."

That "might" work, but if the physical evidence doesn't match (i.e. the perp's fingerprints don't show up on the gun and/or bullets)--the shooter is in for yet another potential problem.
