SESSION 2001
SENATE BILL 1423

Short Title: NC Lottery Abatement Compact. (Public)
Sponsors: Senator Wellons.
Referred to: Appropriations/Base Budget.
June 13, 2002

A BILL TO BE ENTITLED - AN ACT TO DIRECT THE GOVERNOR TO ENTER INTO A COMPACT WITH THE STATES OF SOUTH CAROLINA, VIRGINIA, AND GEORGIA FOR RETURN OF A PORTION OF THE LOTTERY PROCEEDS IN THOSE STATES ATTRIBUTABLE TO SALES TO NORTH CAROLINIANS IN EXCHANGE FOR THE ABATEMENT OF THE CONSIDERATION OF ESTABLISHING A NORTH CAROLINA LOTTERY FOR A PERIOD OF FIVE YEARS.

The General Assembly of North Carolina enacts:
SECTION 1. The General Statutes are amended by adding a new Chapter to read:
"Chapter 143D.
"North Carolina Lottery Abatement Compact.

"§ 143D-101. Execution of compact.
The Governor shall execute a compact on behalf of this State with the states of South Carolina, Virginia, and Georgia legally joining therein in the form substantially as follows:
The contracting states solemnly agree.

"§ 143D-102. Findings and purposes.
(a) At the present time:
(1) North Carolina does not operate a State lottery.
(2) South Carolina and Virginia operate state lotteries.
(3) Georgia has created a Georgia Lottery Corporation that operates a lottery for the benefit of the state of Georgia.
(4) North Carolinians play the lotteries in these three states.
(5) Possession of lottery tickets is illegal in North Carolina, pursuant to G.S. 14-290.
(b) The General Assembly of North Carolina has been considering the establishment of a State lottery since 1983.
(c) The abatement of consideration of a North Carolina lottery would be financially beneficial to the states with existing lotteries through the prevention of competition from a new and novel lottery in North Carolina that would reduce the lottery incomes to those states.
(d) The organizations operating the lotteries can determine exactly what portion of their net proceeds come from sales of lottery tickets and shares to North Carolinians, since the operators must identify the winners of certain prizes under federal law, and the winners are a random sample of the players of the lottery games.

"§ 143D-103. Agreement of parties.
The parties agree to the following:
(1) North Carolina agrees not to establish a lottery for a period of five years from the effective date of this compact.
(2) The states of South Carolina and Virginia will submit to the North Carolina Office of State Budget and Management, no later than March 1 of each year, the audited figures for the amount of gross sales of tickets and shares to residents of North Carolina for each game operated by their state lottery.
(3) The state of Georgia shall require that the Georgia Lottery Corporation submit to the North Carolina Office of State Budget and Management, no later than March 1 of each year, the audited figures for the amount of gross sales of tickets or shares to residents of North Carolina for each game operated by the Georgia Lottery Corporation.
(4) North Carolina shall have until May 15 to accept or protest the figures submitted about the gross sales of lottery tickets or shares to residents of North Carolina. If North Carolina protests the amount, then the amount in controversy shall be placed in a fund and held in escrow until the issue of the amount of gross sales attributable to North Carolinians is determined in an appropriate forum.
(5) When the amount of gross sales of tickets or shares attributable to the residents of North Carolina is determined, the lottery state shall transmit to the Treasurer of North Carolina an amount equal to seventy percent (70%) of the net proceeds from those gross sales.
(6) North Carolina shall amend G.S. 14-290 to make legal the possession of lottery tickets sold by the lotteries in states that are signatories to this compact.

"§ 143D-104. Withdrawal from compact.
Any state that is a signatory to this compact may withdraw from the compact by enacting a statute repealing the same, but no withdrawal shall be effective until the Governor of the withdrawing state shall have sent formal notice in writing to the Governor or each other party state informing those Governors of the action of the legislature in repealing the compact and declaring an intention to withdraw. The withdrawal shall be effective on a date set by the withdrawing state, but not less than 90 days after the enactment of the withdrawal statute."

SECTION 2. This act becomes effective either on July 1, 2002, or upon the enactment by the states of South Carolina, Virginia, and Georgia and approval by the Congress of the United States.

I think it breaks down like this - North Carolinians SUPPORT their durn lotteries by buying tickets. Now, some goober in the state assembly wants a ton of that scratch back.

Do the gobs of loot go to lottery ticket purchasers? Nooooooo...

Yeah I don't get the reparations angle either. NC can pass any laws it wants to. GA, SC and VA are under no obligation to do anything with NC in this matter and ought to tell the State to go to Hell and mind its own business.

The premise here seems to be that citizens are a state's chattel, like cows, to be milked for their income. If some other state has gotten that income, then a trespass has occured and reparations are in order. How typical.

And for any amount! Hey, everyone knows how Virginia, South Carolina and Georgia rip off North Carolinians with those lottery tickets. Those states OWE North Carolina.

Besides, North Carolina's revenues aren't coming in as quickly as planned and I'm sure the other states will feel obligated to pay their fair share...

Yep, I knew it. Reparations are coming, and what's worse, is that this cancer will indeed spread. I live in Minnesota, and you can better believe that since we have Powerball, and since it generates revenues, The people who participate will get screwed hard, only to have that money go to a small group of people. This is all a sham. If the whole reparations goes through, I'm leaving this country, taking my wife, and my small business to some other country, that does NOT support Reparations.

The bombastic audacity to think that NC could demand another state to fork over some of its revenue because N.Carolinians spend money outside NC is beyond comprehension.

TN, Ga, SC and Va should pass laws demanding the NC turnover a portion of the sales tax proceeds its citizens spend while travelling through the state. And, out-of-staters who vacation in NC are not spending their money in their home states. These states should demand compensation for NC luring its citizens to spend their hard earned dough here.

We're getting rid of ours in a few short months. At least ours hasn't based a budget on nonexistant income from a nonexistant lottery to pay for everything. If we're really lucky ours will keep his word and go lay down in front of those trucks heading into SRP......maybe they will not see him and mistake him for a speed bump.

The last time South Carolina "entered a compact" and then "sent formal notice in writing" the federal government sent troops down here and took our guns and burned our homes. Lesson learned. No thanks.

I'd say NC would be in violation of the Constitution if they try to enact this.

This is one instance where the Commerce Clause of Article I Section 8 legitimately applies, IMO.

Especially when you're going to be labeled a racist for believing that the people that should be held responsible are in AFRICA, rather than the people whose families never owned slaves. This is a lie, and a poisonous one at that. I want Blacks to rise up and tell me that I need to pay to live in my own country. I'm 1/8th Cherokee, and let me tell you about reparations. I have ancestors from Germany, and The Cherokee nation. I'm well within my rights to get all kinds of benefits. I choose not to. Blacks whose families stayed here, even though most were offered repatriation, shouldn't be offered ANYTHING. I have endured the discrimination of being a white person for the last 15 years. I have paid taxes to support people of all races. I've paid taxes so that black criminals be kept off the streets. I've paid taxes so that blacks can get an education. I've paid and paid and paid, and I myself am NOT eligible for food stamps, welfare, free medical coverage, free education, ANY of it. Why? Because I'm an able bodied white guy who happens to make his own living as an artist.

Every time I go to wal-mart, or sam's club, or any fast food restraunt, I am treated like a second class citizen. Everyone who isn't white assumes since I'm a white bald guy that I'm a racist. I've been treated so poorly at Sam's Club that I never ask for help, nor do I go to check out lines with Somali workers. I despise having to deal with people who treat me as if they are owed. If they were owed so much, then why didn't they repatriate themselves to Africa and bring those who committed those injustices to their ancestors to justice? It's not about justice. It's about being lazy, and wanting yet another hand out at the expense of everyone else. It's about creating yet another rift in the American people. This time however, since I'm white, I'm going to be a villian what ever side I take. I am so sick of people trying to STEAL what they aren't willing to work for. I am so tired of lawyers, and other people who make their living from deceit, lying to the media, and to the American People, telling them why if they don't pay up that Blacks and whatever rent-a-mob people they hire will trash their city. Look at what the black people have done to their neighborhoods. When they destroy it, then they want the taxpayers to rebuild it, only to destroy it again. Why do we allow this to continue?

If Reparations happen, then we need to repatriate ALL recipients of that bounty to whatever African country their ancestors come from. Ban them from every returning to the United States, and label them as hostile dissidents. Then our government should sue Europe, and Africa for all of the money they can, because the Europeans who went to Africa, and the African Warlords who sold the slaves in the first place, should be held accountable. Any blacks who don't take the check should be allowed to stay here, shut up and get along. Heaven knows it's a dream to have people actually get along, but it's all part of the plan to keep people stirred up and uncooperative, so that government can do whatever it wants, and steal the freedoms that ALL races in this country enjoy.

I am in the same boat as yourself; I am willing to work for my own living, even if it requires working 80 hours a week (and I've done so) to stay off the government dole. I am sick and tired, as a taxpayer, of carrying the nation's deadwood regardless of their color/race.

But the reparations thing is where I draw the line. They will get none of my hard-earned belongings without a fight to the death. I'm dead serious; that's my line in the sand.

I know that there are many hard-working people that agree and they aren't all white folks either. Any black person that has risen on their own efforts is likely to be appalled at the mention of reparations.

I don't think its about lazy so much as its about us being accepting of the behavior. That we let mobs trash cities without the citizenry raising arms against it is bad enough; that we pay as taxpayers to rebuild is even worse. For intelligent people, we sure are stupid sometimes.

You're right as far as where the blame goes for slavery in the first place. There's plenty of evidence that points this out. But to the Jackson/Sharpton gang, its whitey's fault regardless of involvement.

Reparations will tear this country in two. There will be a war over it if it ever is approved by our elite rulers. Its sad because, like you said, this could be such a great place to live if people truly did take care of themselves and get along. But the lawyers and the thieves are stealing from the productive and that is killing us all.

You all need to go back and read the article again. NC is agreeing with the surrounding states to NOT implement a NC state lottery of their own. In consideration for NC refraining from starting their own lottery, for a five year period, the surrounding states are agreeing to pay NC for that state's residents for their proration of the lottery gains.

Seems to me a fair agreement between all states involved. Especially, if NC allows ticket sales for the other states within NC.

Seems to me most of you read the word REPARATIONS to mean money to go to its BLACKS in reparation for slavery.

You need to go back and read the article once more and this time try to comprehend its true meaning.

Actually, I disregarded the word "reparations" because I didn't figure what they were even including it for.....lol

You may be right - but to me, it read like NC was saying to the other states they would not compeete with them as long as they gave NC part of the profits........ lol......that sounded kinda like blackmail to me........perhaps I misunderstood?
