I'm afraid to disillusion you of your theory but the President is not allowed to ask the Supreme Court for an advisory opinion about the constitutionality of legislation. And the Supreme Court doesn't give one. As to the President's "brilliant strategy" I'm afraid all the facts show the President never intended to veto this bill. If he had he would have threatened one at the outset. He will sign the CFR and then its up to the courts to decide if it can be enforced.

Thanks for the ping. And thank you to the Republican Senators who stood up for the Constitution by not voting for Cloture. The rest of them - enjoy your perks because you won't be Senators much longer. The Dems have just seen to it that your fate is sealed.
I can hear the cries in future elections of Repubs- Oh- what happened here? How did we LOSE All those Senate and House seats????? And, then, I can hear the rest of America after we look more and more like Zimbabwe - how did this ever happen to us. Well mark this down - unless our President finds some kind of wonderful surprise solution - here is where the real downfall went into fourth gear.

Here is the statement from Congressman Billy Bob:
I am privy to some inside information which I am not at liberty to discuss until after this bill reaches the President's desk and he decides what to do with it. However, if he calls a press conference to announce his decision, and the only people who are present with him at that time are Attorney General Ashcroft and Solicitor General Olson, then pay close attention to what is about to happen.
The action taken then and there by President Bush will be something that every President has had the power to do from the beginning, but no President has ever done before, He will deal with this bill in a way no other bill has ever been dealt with. And I think that the members of FreeRepublic will be satisfied with the result.
Do not ask questions for more details because I cannot give them. Suffice to say that the proposed plan of action for that moment, if that is Bush's choice, has passed my eyes. As the Archangel Micheal (John Travolta) in Michael says, when asked "How do you know that?" he replies, "I pay attention."

Good, logical question! However, I see President Bush asking the Supremes for advice here although I certainly don't know if he can do this or not. I'm just going by what Congressman BillyBob said last night about no President had ever done it (?????) before.

I think the President will sign it in the middle of the night. And then as soon as the courts open for business, expect Sen. Mitch McConnell and a herd of plaintiffs to file a lawsuit against the measure. For all practical purposes this is not going to be enforced until the Supreme Court makes the final ruling. One thing is for sure: parts of this bill certainly will not survive close judicial scrutiny and will be struck down.

We know Dem operatives monitor this site so you have to believe some word of this has made it's way back to the Rats and Rinos. Certainly someone in that disgusting bunch has researched this subject and reported back to their bosses. Maybe that is the reason for the prevailing mood.
