I want to directly kill the “independence” of the administrative state.

I want to require that they have no independent ability to issue “regulations” (laws).

I want to require that every “regulation” they want to issue is, from their end, no more than a proposal to Congress, and from there the proposal has to go through 100% of the normal legislative process (accepted, or denied to be brought up by appropriate Congressional committees, approved or disapproved by those committees, and if approved by the appropriate commitees then submitted to the full legislative body’s (house and senate) for consideration to be voted on by those bodies and only if approved by the House and Senate become an agreed on “regulation”.

I also want to take away the indendent enforcement powers of the administrative state, requiring that when they think a breach of a regulation has occurred, they get to take no action of their own other than subitting the matter to the Department of Justice for the Departmewnt of Justice, if it agrees, to take the matter into court, where the alleged defendent has all the rigfhts of defense as in any other kind of case.

As it is, like in this case with abortion, the Executive is attempting to make a serious national law that is not the product of any legislative act by Congress.

How does the Executive get away with it?

Right now the executive gets away with it by way of issuing a new regulation in a federal register and it becomes law by Congress inaction against it. That process has to be reveresed in the manner I described above. Federal law, all Federal law has to come out the full legislative process of Congress, not by Congressional inaction.

For Republicans, here is an opportunity to show how Biden does not give a dam about Democracy. Here is Biden attempting by Executive fiat to dictate a national policy about abortion.

Exactly right. This will harm job opportunities for women in mass.
