Simply put, the 14th Amendment applies to those whom have put up arms against the United States. That was its purpose. The problem is that the Democrats have ‘with whole cloth’ attempted by public opinion to change the meaning of ‘insurrection’. Insurrection does not occur when people protest that safeguards for a national election, including state election laws, were subverted and need to be investigated. Insurrection does occur when armed government employees, and unarmed employees, start birddogging a legal protest.
There is ZERO evidence anyone was armed with firearms at the Jan 6th protest, except the Capital police and FBI. Government birddogging of a protest is not the same as the protesters being armed for an insurrection. Further, I see ZERO evidence that Trump organized militia, had armed militia at the protest, or incited violence. There already exists evidence that the government bussed in Antifa, and FBI agents, and fired into a legal protest crowd.
Let the people decide if it was an insurrection, that’s what’s voting is for.

You can’t FIX STUPID
To be honest maybe it really does not matter. The 14th Amendment talks about officers who “...shall have engaged in insurrection...”. It doesn`t seem to require criminal prosecution or even conviction. So maybe it`s for the judges ruling on the disqualification do decide.
The strange thing is that even the dissenting judges didn`t see a problem and apparently didn`t find it necessary to discuss what exactly constitutes an insurrection. Strange because there is no definition of the word in the 14th.

For starters, none of the dissents challenged the district court’s factual finding that Trump had engaged in an insurrection.
