I’m not a lawyer but I agree with your reasoning. I think MF and SP, his brilliant counsel, tried a play in the judicial playbook that normally would work, but this is not a normal case ... so on and on it goes. Now further delay and Judge Sullivan’s “hearing” is up next. I’m confident in the end, however long it takes and however currupt Sullivan et al show they are, Flynn will be cleared as he should be.

Totally bizarre. The state has said they will not prosecute. Corruption and lying on the part of investigators has been proven. Flynn himself claims his own innocence

This batter was mixed and poured into the pan when the Court granted the en banc hearing. All that was left to do was to throw it into the oven for about 30 minutes at 350 degrees.
Not a major setback, just more of the political games going on in the Federal Judiciary. Let it play out and turn this turn of events around to attack corruption in the Judiciary. Trump’s reform of the Judiciary is ongoing with his appointments of Judges. It needs to continue into the second term.

The government withdrew their prosecution. The USSC stated then the court must dismiss as courts cannot act as prosecutors. This court is refusing to dismiss and has started actions as the prosecutor.
Can’t trust them. You know, John Roberts.
