How do you get sentenced when the case was dropped by the prosecutor?
Barr ought to do a HUGE PUBLIC document drop, revealing in detail just how biased and deceptive the prosecution was.

May be wrong but pardon may negate his ability to sue once vindicated which to me must be protected

Yes, he is under a gag order. THAT alone is why they want to punt this past the election. He will blow the lid off of so much very publicly.

No. A pardon indicates guilt. Flynn is not guilty.
You get sentenced because he plead guilty.
As a judge, you say “I accept your plea. Because the government failed to provide recommendations , I must use the i reaction from the sentencing guidelines. Therefore, you are sentenced to.....”
That is how the judge does it.
And I would bet that is how it plays out.
Not really a setback. The court decided that, until Sullivan actually fails to dismiss the case, Flynn can’t ask the next court to intervene.
Most of them seem to believe the case needs to be dismissed, but that Sullivan has the right to hold a hearing about the dismissal before ruling on it.
Sadly, if they had not sued, and won, months ago, this case would probably be over.
Duh. We knew the DC Circuit was going to do this. Keeping this alive until after the election is a major D goal.
