He was designated and announced to the world many months ago as a terrorist and enemy combatant of the US. THAT is/was his legal status. Not some sovereign government figure, which the UN “law” is referencing.
An enemy combatant, out of his home country, in the middle of leading a charge of military to attack sovereign US territory. They/he pulled the trigger starting the conflict and the US retaliated/defended itself. Immediate responder designation just like the Texas church shooting response.
