Montana Supreme Court Strikes Down Missoula Gun Control Scheme

U.S.A.-(Ammoland.com)- Montana has a strong preemption law to protect the right to keep and bear arms and to maintain uniform firearms laws across the state. It is straightforward and easy to understand. From mt.gov:

45-8-351. Restriction on local government regulation of firearms. (1) Except as provided in subsection (2), a county, city, town, consolidated local government, or other local government unit may not prohibit, register, tax, license, or regulate the purchase, sale or other transfer (including delay in purchase, sale, or other transfer), ownership, possession, transportation, use, or unconcealed carrying of any weapon, including a rifle, shotgun, handgun, or concealed handgun.

There are two exceptions to the law:

(2) (a) For public safety purposes, a city or town may regulate the discharge of rifles, shotguns, and handguns. A county, city, town, consolidated local government, or other local government unit has power to prevent and suppress the carrying of concealed or unconcealed weapons to a public assembly, publicly owned building, park under its jurisdiction, or school, and the possession of firearms by convicted felons, adjudicated mental incompetents, illegal aliens, and minors.

Missoula is home to the University of Montana. It represents the far-left politics in the state.  In Missoula, in 2018, the Democrat candidate for Senate received 41,688 votes. The Republican candidate received 18,631 votes, about 31%. Statewide, the Republican candidate received 46%.

In 2016, the City of Missoula passed an ordinance to require private sales of firearms to be approved by the government.

Montana is being Californicated.
Colorado has been Californicated.

We really need to design and implement a usefulness filter for California refugees. If: actor, Google employee, ex-politician, or progressive (progresive outweighs all of the others combined), the toxic individual will be bound, gagged, and shipped immediately to the streets of San Pelosishitsco and dropped onto the nearest pile of Obamastuff.

That is why I live in the MOST CONSERVATIVE state in this Republic, the state of Alabama!!! It is the 2d most Christian state, just a point behind Mississippi!! Ole Miss is the 2d most conservative state. We stand for what the Constitution says, not what the commies say. Come on down. Live free.

What this shows is that there is no respect or understanding of laws. They have NO respect or understanding of state or federal laws. It is mob rule. Does not the city have an attorney to explain laws to them?

Montana has ALWAYS been a democratic state.

It was not until 1994 that a Republican Senator was RE-elected to office.

We had a ‘Republican’ Governor who tried to pass a state-wide sales tax (no, we do not have one). It was defeated 75% to 25%. “I guess I learned my lesson on that one”, Racicot said later. After he was reelected he again tried to pass the sales tax - defeated 80% to 20% this time. He went to work for the Bush 43 administration...

Jeannette Rankin represented Montana and was the ONLY member of the House to vote against declaring war on Japan after Pearl Harbor.

Troglodytic morons have a history of buffoonery in my state.

No, it’s TOTALLY EXPECTED from Democrat judges. And it’s no different than their types of rulings at the federal level.

And so, as I keep harping on, JUDGES MATTER, and the only way to get good judges is to give Trump REPUBLICAN Senators, and yes, that does include RINOs, as they almost always support Trump’s judges, whereas Schumer and virtually all Democrats have NEVER supported a contested conservative judge...at least not in the past 20 years.

From the article:

One of the results of the power grab by the City of Missoula was a referendum referral to the people to remove the power of municipalities and other local governments to regulate firearms. The referendum is LR-130. It will be on the ballot in 2020. From ballotpedia.org:

My daughter went to Missoula. She heard lots of students complain about how liberal it was. She laughed. “In High School I knew two other conservatives - and one was my sister!” (She thought the ratio at college was more like 30/70 instead of 3 out of 400 as in high school).
