‘The Supreme Court Is Not Well. And the People Know It.’ [Mega Barf Alert]
The Atlantic ^ | September 2, 2019 | Garrett Epps

Posted on 09/02/2019 6:44:11 PM PDT by fwdude

The Supreme Court as we once knew it—as a national institution that could at least sometimes stand apart from partisanship—died last year. The ongoing fight over its corpse spilled into public view last week.

On Thursday, 53 United States senators—every member of the Republican caucus—wrote a “letter” to the clerk of the Supreme Court assuring the justices that the Republican Party has their back. The Democrats, the senators told the Court, pose “a direct, immediate threat to the independence of the judiciary.”

The spat is about guns. The Court has granted review in a Second Amendment case entitled New York State Rifle & Pistol Association Inc. v. City of New York, New York, which (nominally) tests an obscure New York City ordinance governing how firearms owners could—note the past tense—travel with their weapons.

“...the court is no longer firmly in radical leftist hands and therefore it’s “broken.”...”

That is what it is about. These America-hating, Constitution-busting communists are attacking every important element of American greatness. Outright sedition and treason.

Traitor Roberts is certainly very questionable.

He needs to be held accountable for his FISA Court.

Now it is, finally, starting to do its job to uphold the Constitution as written.

The left cries “Foul”! <<

Amazing isn't it!....the left would like to amend the process willy-nilly by bypassing what it meant by... “as written”....in the day you didn't have to be a lawyer..you had to be a Constitutional Scholar!

That was the ONLY job of the SC..to interpret it as “written”

To convey how cynical this is, imagine that in 1937, Franklin D. Roosevelt had proposed his “Court packing” plan—and then accused Republicans of seeking to make changes in the sacred number of justices. The Court is already packed; the packing began in February 2016, with Scalia’s death, and continued with the Gorsuch nomination and Kavanaugh’s tantrum before the Judiciary Committee. And the packing effort has not even paused; Mitch McConnell has publicly said that regardless of the “election-year rule” he invented to block President Barack Obama’s nomination of Merrick Garland, Republicans will confirm another justice to the Court if a vacancy occurs next year.
The loony toon is using the term “Court packing” to mean two different things (which is equivocation):
  1. Republicans winning an election based, to a large degree, on the issue of who should get to fill the vacant Supreme Court seat, combined with McConnell not allowing a vote on Obama's nominee, without inventing any new rules of any kind to accomplish that and which Democrats have also repeatedly done over the years.
  2. Roosevelt threatening to amend the constitution to add more justices to SCOTUS because they weren't ruling in accordance with his wishes, in order to pressure the sitting justices to change their legal decision (which the threat succeeded in doing) or failing that, to change the rules in a way that would enable him to make an inordinate number of appointments.

In fact, some Republicans openly opine that the Court issue is what won them the 2016 election—and when pressed about their lack of legislative accomplishments, they point with pride to their partisan makeover of the federal bench. Must we also be subjected to their solemn panegyrics to “judicial independence”?

The term “judicial independence” means that sitting judges are not subjected to outside pressure to alter their votes. What in that idiotic paragraph demonstrates such an attempt by the Republicans? It is only the Democrats that are actually doing or have done such a thing. He's apparently saying that appointing judges that correspond to one's own philosophies erodes “judicial independence”. This idiot has an bad equivocation problem.

IMHO, the court won’t be “well” until President Trump gets two more appointments.

Leftist dogma:

Healthy is America hating, and ignoring our Founding Documents.

Unhealthy is America loving, and sticking with the U. S. Constitution.

Who gives a rat’s ass what the Left thinks?

I'm curious about Garrett.

If you clubbed the lying sack of Mitt like a baby Harp seal, would actual brains come out of his ears? Or would it be just be Mitt oozing out?

The Supreme Court has always been somewhat hit or miss. Roe v Wade and Dread Scott being two good examples. FDR wanted to pack the court with his appointees back in the day & typical of democrats lack of respect for separation of powers.

Wow, that’s quite a spindly construction of lies the story creates. Out of an unconstitutional law, unprecedented Democrat Senate threats to the court, and one poll pushing “a less political court”, the story comes out with a Bizarro World take on reality.

Who’s the bad guy here? New York City that clearly deprived its citizens of God-given constitutional rights? No, the NRA.

So this is what the Democrats do when court rulings strike down their shibboleths? They are going to howl with what’s coming up next.
