McConnell Smooths Path As He Prepares To Break Glass On Nuclear Option
Talking Points Memo ^ | March 6, 2019

The breakneck speed with which Sen. Majority Leader Mitch McConnell (R-KY) has shepherded Trump-friendly judges through the confirmation process is apparently not enough — according to Politico, McConnell is clearing the way to smash the glass on the new nuclear option.

McConnell wants to change the rules so that lower-court nominees can be confirmed by a simple majority vote, an easy way to circumvent Democratic obstinance. Per Politico, Republicans think they have the 50 votes for the nuclear option but would prefer party unity. Sen. James Lankford (R-OK) was reportedly on the Senate floor trying to woo moderate Sen. Susan Collins (R-ME) on Tuesday.

I’ve been hearing this “nuclear option” crap for a year. Blah blah blah.

I’ve always hated the filibuster rule. I know the Constitution says the Senate can make their own rules. But I always interpreted that as within the rules already outlined by the Constitution. So the 60 vote Senate rule violates the Constitution’s Article 1 rule of laws being passed with simple majority vote.

Last time I checked, bills and confirmations are passed by majority vote. The filibuster, once used only in extraordinary situations and requiring actual debate to continue ad infinitum, has been replaced by a complete fiction that requires no effort or commitment. And far from being saved for extraordinary votes, the minority routinely filibusters every vote they disagree with. This fiction has long outlived its usefulness and had turned the Senate into bad political theatre. I say good riddance.

“McConnell wants to change the rules so that lower-court nominees can be confirmed by a simple majority vote”

I don’t get it. I thought they already did that. For sure, they just need a simple majority for SCOTUS and Circuit Judges. So lower court judges require more than that? That doesn’t make sense.

Like Eric Peters wrote...the Con (second con) is doing now what the writers intended!
(rigged! as another recently described it!)
0bama wasn’t the first to point out the con was/is “flawed,” etc.

Gary North’ Conspiracy in Philadelphia a good example.

*******************************************************
Senator Collins is in danger of losing her upcoming reelection attempt for the same reason that former Senator Kelly Ayotte (who, once in the Senate, allowed herself to be politically corrupted by John McCain) lost her re-election bid — as a result of trying to pander to all sides. The Left will always vote for her ‘RAT opponent despite her STUPID attempts to placate them and a significant (and likely decisive) number of conservative patriots will decide not to vote in the Senate line on their ballot.

“I don’t get it. I thought they already did that.”

I think that the article fails to discuss the current requirement that allows each Senator up to 30 hours of debate on each nominee. McConnell has reportedly reduced that to 2 hours recently. As I see it, it isn’t the lowering the final vote to a simple majority, it’s cutting out the crap that allows the RATs to string out each nomination and in so doing, cut the overall number of nominees they can entertain in a Congressional Session.

The only change that needs to be made is that they need to get rid of the fake filibuster. Make the obstructionist bastards stand there on the floor reading the phone book. (or even better, bills that never actually get read by anyone). That will end the foolishness, and return the filibuster to what it once was, a seldom used parliamentary tool used in extraordinary circumstances.

“current requirement that allows each Senator up to 30 hours of debate on each nominee”

Yeah, I thought maybe the article made a mistake....that what’s going to change is the 30 hr crap...I’m wondering if they just made a mistake. I suppose I ought to check who wrote that Talking Points Memo.
