Defense Official: Nothing Stopping Trump From Building Wall with Military

During a House Armed Services Committee hearing on Tuesday, Under Secretary of Defense for Policy John Rood confirmed to Rep. Mo Brooks (R-AL) that Trump does not need Congress or a national emergency declaration to build a wall along the U.S.-Mexico border.

The exchange went as follows:

BROOKS: I want to direct your attention to 10 United States Code § 284 which authorizes President Trump to deploy the United States military to the southern border to build fences and to do a lot of other things, and for clarity, if you look it up in the dictionary the word fence includes the word barrier and the word barrier includes walls made of a wide variety of different materials.

So that having been said, it seems to me that 10 U.S. Code § 284 can be used by the President of the United States to direct the United States military to build a wall...

BROOKS: Does 10 U.S.C. § 284 as you understand it, require the declaration of a national emergency before it is implemented?

ROOD: No.

BROOKS: It does not?

ROOD: No.

BROOKS: Has President Trump, to your knowledge, ever used 10 U.S.C § 284 to direct the military to build the wall that is necessary for border security?

ROOD: No, not to my knowledge, Congressman.

BROOKS: If President Trump were to direct the Pentagon and the United States military pursuant to 10 U.S.C § 284 to build such barriers as are necessary to secure our southern border from drug trafficking and international crime cartels would the United States military obey that order?

ROOD: If we judge it to be a lawful order, yes sir. And I assume it would be.

Congress has been shirking their duties and ceding power to the Executive branch for decades. It would be karma for it to benefit our side for a change.

Lots of reasons why mid-term is better.

The Military needed its catch up budget after years of Obama and sequestration, that it would not have gotten if the wall was rolled in.

Lots of Wall issues had to be worked, before dropping the big money - what is the best design, what is the best route, what is the priority for construction, how can we get around Leftist lawsuits, how can we best get right of way from all the private landowners, how can we work around binding treaty requirements, etc..

All of that is now solved. Beyond the planning and procedures, Government contracting itself has a significant lead time. The contracts are now standing, with a pool of pre-approved vendors ready to quickly bid out each segment - it is all tested, with three segments completed and fourteen more recently awarded.

This is just the point in the program where the planning and prep are complete, and everything is ready to ramp up - ready for the money bomb.

Target this is a judicial friendly area, maybe Texas, in a very specific, limited area. IfWhen that works, expand the area but stay away from the 9th circuit for now.

I bet Trump is awaiting the final 12’ X 30’ steel stat panels to be loaded on the trucks. It takes a little time to make 132,000 of them for the 300 miles of strategically placed barriers.

If it took a 20-man crew to build one mile of fencing in a day, 6,000 men could build that 300 miles in one day.

The steel panels are 30 foot high. Falls from that height cause severe injury that can be fatal.

Fly in the Ointment - under subsection I.3, by definition, any “small scale project” cannot exceed $750,000 in cost.

That’s where the RATs will attack this legally - if Trump moves ahead, they will need hundreds of work orders.

Would the construction of the Border Wall be one of those “red lines” Trump has been ordered not to cross by Left?

We do know the Left never backs down - they only double down.

Something we all need to emulate, should they attempt to jackboot us from a position of real authority.

However, to your point: I do believe POTUS is using their tactics against them.

Also: I cannot name one act of either tyranny or treason from our President. I’ve seen videos where progs are asked for the list of oppressive acts and every time, they cannot. The longer this goes on, the list on the other side and the number of players not only grows, more and more people become aware of it.
