Newly-Elected DA Vows To Stop Prosecuting Resisting Arrest And 15 Other Crimes

Boston, MA – When Suffolk County’s district attorney-elect Rachel Rollins takes over the prosecutor’s office in January, criminals will no longer need to worry about being held accountable for many offenses – including resisting arrest.

“It’s a recipe for disaster,” veteran Boston defense attorney, Robert Griffin, told the Boston Globe.

“The problem is the message that you’re sending,” Griffin stressed. “You’re encouraging bad behavior. You’re telling people that we’re not going to do anything about this.”

Rollins, 47, has been widely hailed – and widely criticized – for her well-publicized “Charges to be Declined” list, which she has featured on her campaign webpage.

With rare exception, offenses of shoplifting, trespass, threats, and larceny under $250 will no longer be prosecuted, as well as disturbing the peace, disorderly conduct, and “minor driving offenses,” according to the list.

Breaking and entering will not be prosecuted, as long as the perpetrator makes sure the property is vacant. Alternatively, those who commit break-ins of occupied homes because they are cold or tired, but don’t damage anything, will also be in the clear.

Offenders won’t have to worry about going to court over receiving stolen property or underage drinking, and won't be held accountable for wanton or malicious destruction of property, either.

Making threats will also be permitted, with the exception of those related to domestic violence.

Drug possession will no longer be prosecuted in Suffolk County – even in cases where the suspect is a drug dealer.

Cases where an offender is charged with resisting arrest and nothing else will also be turned away, as well as any instances where the person resists arrest while being charged with another offense on Rollins’ “Charges to be Declined” list.

CHARGES TO BE DECLINED

Charges for which the Default is to Decline Prosecuting (unless supervisor permission is obtained).

Trespassing
Shoplifting (including offenses that are essentially shoplifting but charged as larceny)
Larceny under $250
Disorderly conduct
Disturbing the peace
Receiving stolen property
Minor driving offenses, including operating with a suspend or revoked license
Breaking and entering — where it is into a vacant property or where it is for the purpose of sleeping or seeking refuge from the cold and there is no actual damage to property
Wanton or malicious destruction of property
Threats – excluding domestic violence
Minor in possession of alcohol
Drug possession
Drug possession with intent to distribute
A stand alone resisting arrest charge, i.e. cases where a person is charged with resisting arrest and that is the only charge
A resisting arrest charge combined with only charges that all fall under the list of charges to decline to prosecute, e.g. resisting arrest charge combined only with a trespassing charge

Instead of prosecuting, these cases should be

(1) outright dismissed prior to arraignment or
(2) where appropriate, diverted and treated as a civil infraction for which community service is satisfactory, restitution is satisfactory or engagement with appropriate community-based no-cost programming, job training or schooling is satisfactory. In the exceptional circumstances where prosecution of one of these charges is warranted, the line DA must first seek permission from his or her supervisor. If necessary, arraignment will be continued to allow for consultation with supervisor. Thus, there will be an avenue for prosecuting these misdemeanors when necessary but it will be appropriately overseen by experienced prosecutors. Note: this is essentially already happening for drug possession cases in Roxbury and Dorchester District Court.

Look for mortgage insurance rates to increase that is if you can find an insurer willing to sell you a policy.

This is just anarchy.

For just one example — no prosecution of shoplifting. Why would anyone every buy a book in Boston? Just go to a bookstore, pick up a couple of volumes and walk out. Only fools would pay. Works for liquor stores too. Anywhere. Just grab what you want and go.

I’m sure that will depend on who makes the threat and who is the object of the threat. Black or any other kind of minority threatens white will be permitted, white threatens black or any other minority will be prosecuted. Woman threatens man will be permitted, man threatens woman will be prosecuted.

Seriously, the Romans also invited the barbarians in because their citizens were too tired to work, to fight in the Legions, to fight the corruption in the Senate and in Rome, and (eventually) to resist the invasions.

I'm not sure that petty thieves are a demographic that curls up with a good book and reads very much.

But liquor stores -- I have no idea how they can deal with this.

Of course I’m being glib, but I mention bookstores and liquor stores with a purpose.

Sure, you’d kind of expect the criminal element to start lifting merchandise from liquor stores. No real surprise in that sort of thing.

But imagine someone in a suit and tie, on Beacon Hill, off to his job on the 24th floor of a big downtown skyscraper — and the guy just pops into a bookstore, grabs a couple books and walks out.

If the middle class starts thinking that laws don’t matter, I’d say you have a big problem.
