California Farmer Attempts to Comply with Law and is Arrested

Last month, April, 2018, the California Department of Justice raided prominent Kern County Farmer, Jeffrey Scott Kirschenmann. The justification for the raid was pictures the farmer had sent to the Department of Justice in an attempt to register a rifle. The DOJ claimed the rifle was an illegally modified “Assault weapon”.  During the raid, the DOJ confiscated 230 rounds of ammunition, a dozen guns, two objects claimed to be “silencers”, and some sort of trigger activator.

There is reason to be wary of the accuracy of the claims of what was found during the raid. California law is very complex. California law enforcement officers have been known to make mistakes about what is an “assault weapon” and what is not. “Silencers” can only be determined with a test to see if the devices actually reduce the sound signature of a firearm. There are many fake look alike simulated “silencers” on the market.  From kget.com:

Retired KCSO Commander Joe Pilkington is a court recognized firearms expert. He could not speak directly to Kirschenmann's case but says the laws are changing so frequently, it's often hard to keep up with the latest regulations.

“Just in the last few years, there have been lots of changes in gun laws,” he said. “Making an effort, a good faith effort to comply with these really complicated laws, should count for something.”

A new state law requires assault-style weapons be registered by the end of June.

Pilkington recommends anyone who isn't sure about the process go through a federally licensed

Keep this in mind when they talk about doing background checks to prevent criminals from getting guns. Sounds like a good idea until you realize that ANY violation merely associated with a firearm is considered a “gun crime”. Most folks hear “gun crime” and think robbery.

So, for example, this farmer now has committed a “gun crime” and won’t be able to get a concealed carry permit in any state - ever.

230 rounds of ammunition

Barely enough for a day at the shooting range.

Did you really think we want those laws observed?” said Dr. Ferris. “We want them to be broken. You’d better get it straight that it’s not a bunch of boy scouts you’re up against... We’re after power and we mean it... There’s no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren’t enough criminals one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What’s there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted – and you create a nation of law-breakers – and then you cash in on guilt. Now that’s the system, Mr. Reardon, that’s the game, and once you understand it, you’ll be much easier to deal with.”

Here you have a guy who tried to “do the right thing” by coming forward himself to comply with the law and they SWATTED him.

The lesson is crystal clear, never trust the government! Goes double in Kalifornia.

All he had to do is disassemble the rifle.

If he is convicted of the felonies he has been charged with he won't need a CCW because he won't be able to legally own any firearm in any of the 57 states of the USSA.

Leftists are horrible people. We must fight them continuously to keep our God given freedoms. Never believe a leftist. Never negotiate in good faith with one. They are evil, mentally disturbed humans and there is no shortage of useful idiots like the police who arrested this farmer who are willing to do the bidding of leftists.

Firstly, never try to comply with gun laws. That is the lesson here. Just keep quiet about what you have.

We need to get enough strict constructionist judges on the Supreme Court to strike down all the myriad of various restrictions the socialist states have passed on guns as unconstitutional infringements on the 2nd Amendment - which they are.

" Confiscated 230 rounds of ammunition."

It must be a crime to have ammunition in California.

Im with you on that question. I shoot more than that everytime I go to the range.

Perhaps its because wach round has a warning: This product contains a chemical known to the state of California to cause cancer.

OR
WARNING: This product contains a chemical known to the state of California to cause birth defects or other reproductive harm.

I wonder how many police “heroes” refused to carry out this obviously unconstitutional raid. I’m guessing none. The police are not your friends nor are they friends of the constitution. Don’t expect any refusals from the police when the order to confiscate all firearms comes.

Calling the police useful idiots is inaccurate. They are wiling participants in the destruction of our God given rights. People don’t become police to not enforce laws.

The Supreme Court does not seem interested in hearing appeals.

Haven't you noticed this yet: the US Supreme Court is a bunch of moral cowards who are more than willing to let a lesser court's unpopular jurisdiction stand, thus becoming the "law of the land" than making a stand for what's right. (Proposition 8 was a good example.)

What's really disgusting is the total ignoring of one simple fact: the Constitution is superior to the supreme court, it establishes and authorizes it, and therefore the supreme court CANNOT be of a greater authority than the Constitution… but little things like A1S1 would really put a cramp in their usurped powers.
