Supreme Court upholds new Pa. congressional district map, rejecting Republican challenge

The new congressional map imposed by the Pennsylvania Supreme Court will be used in the 2018 elections, after courts rejected two challenges Monday.

First, a panel of federal judges Monday dismissed a lawsuit challenging the new map imposed by the Pennsylvania Supreme Court, saying the Republican lawmakers who brought the challenge did not have standing — “We hold that the federal Elections Clause violations that the Plaintiffs allege are not the Plaintiffs’ to assert” — and that the case is not appropriate for the court to take up at this time.

“In short, the Plaintiffs invite us to opine on the appropriate balance of power between the Commonwealth’s legislature and judiciary in redistricting matters, and then to pass judgment on the propriety of the Pennsylvania Supreme Court’s actions under the United States Constitution,” they wrote. “These are things that, on the present record, we cannot do.”

Within hours, the U.S. Supreme Court rejected a separate request from top Republican state lawmakers that the court step in and block the map.

I agree. Republicans should fight the blue states that are misrepresented. However, liberals use the race issues as a fighting mechanism which gets judges attention. Not having the right amount of seats isn’t very glamorous.

By the way, I truly believe that the Republicans like being in the minority. I believe they will be thrilled to lose in November. First of all, they still make the same money even if they get kicked off committees. I kid you not, if they make 15K for being on a committee, they get that for LIFE regardless if they are on it ever again after 1 year. That is why so many Congressmen make more then 180K. They get 15K per committee and other monetary benefits that cannot be taken away once they get it. Sick huh?

You act like I made the decision. If these idiot Republicans can’t keep their seats, that is on them. They haven’t done a thing except tax relief. That is it in 15 months. At least the Senate has confirmed judges. I don’t see much difference in the House. They are useless. So take that answer and shove it.

Yeah, it’s sickening.

Also, Mass. and Conn. are far too gerrymandered for any R to win. I think Minnesota is up for some flips though (looks like the right candidates have a good shot at 3 seats there).

What a convoluted bunch of legal issues. Apparently the democrat minority in the state legislature did have standing to sue in state court because they don’t like the old map of congressional districts, but a minority of Republicans didn’t have standing to sue in federal court over the issue of state courts seizing power from the state legislature. This means now that state supreme courts can draw up legislative districts against the votes of the people’s elected representatives if the state supreme courts decide to do that. This is more unconstitutional seizure of power by the judiciary.

I don’t fully understand why the federal courts think this isn’t a serious issue worth serious consideration. I get the feeling that the federal courts and the SCOTUS have more respect for the judgment of state courts than the judgment of state legislatures. This is still more judicial arrogance in which the judges in black robes once again assume they’re wiser than the voters and their elected representatives. I do not concur with the judges in black robes on this legal issue.

I’m just wondering when his true colors will come out. I don’t think the Dem party allows people like him on the team, even from the South & Midwest. They’re not Leftist enough. What little I read about his policies, he seemed to appear just as much a Republican as most of Congress.

He was given permission to run on that platform. If, or when he gets the seat, he’ll come out.

We Pennsylvanians don't have to look that far as we are bound on three
sides by Marxist states: NY, NJ, and MD. If this redistricting gives the
state's legislature back to the Dems then Comrade Gov. Wolf will have us
on the fast track to join them.

This was an application for a stay of the lower court’s order. Any single Justice can grant a stay. Justice Alito denied it first then submitted it to the other Justices, which is standard practice. None of the others granted the stay.
It takes four Justices to grant a petition for a writ of certiorari which means moving an appeal to oral arguments before the full court.

No, each state chooses, by law, its own method of redistricting but anyone can challenge a redistricting plan in court. Nearly all redistricting plans are challenged in courts though because somebody is always uphappy.
Some states have multi-partisan, independent commissions that draw up district boundaries (ie 5 registered Republicans, 5 registered Democrats and 5 registered independents).
