While this murder does not meet any federal criteria (I believe) if it did, both the state and the feds could charge him with the same offense under the dual sovereignty doctrine.

The intent of the Federal charges is to make him pay for the murder. It is another bite at the apple, as much as it pains me to accept. It really doesn’t matter what court is involved, it is still the government going after him. This scumbag isn’t worth trashing the Constitution yet again.
I think the intent of the protection against double jeopardy is pretty clear, and the intent was not to define the same crime multiple ways, as this nullifies it.

The two are completely different. A criminal case is for a violation of a government's laws, while a civil case is for a wrong done to an individual. Just because the government got to bring its case shouldn't preclude a wronged person from bringing his case. Also, the standard of proof is different. For criminal, it's beyond a reasonable doubt. For civil, it's preponderance of the evidence (i.e., more likely than not).

Not at all. According to existing immigration law, illegal entry the first time is a misdemeanor. The second time and thereafter, it is a felony with up to 10 years in prison.

SCOTUS has ruled that a trial in state court and a trial in Federal court for the same crime are entirely different and don't violate "double jeopardy".There was a soldier a few years ago who was acquitted on a murder charge in state court but was then found guilty in a court martial.
