Has Ben Shapiro Been Watching Too Much Judge Judy?

Ben Shapiro is one of a number of conservative journalists recently bent on assuring us we're at liberty to disregard due process of law in formulating our verdict on Roy Moore. We have his permission, he tells us, because we're deciding on political issues whose disposition won't result in sending anyone to jail. But this misunderstands what due process is and strips us of much needed protections.

Protections? you may ask. Wherefore do we need protections if the state is not involved in our decision to, say, condemn someone we feel has been proven to our satisfaction to be a child-molester? Simple. We need the institutional model of due process as a reminder to shield us from brow-beating rhetoric like Shapiro's that would structure our choices for us and insult our morality and intelligence if we don't acquiesce to its forced conclusions.

There are many reasons due process is relevant to our responses to the allegations against Roy Moore. But first, contrary to popular portrayals, let it be said that due process is not a "concept." It is an umbrella term referencing a constitutionally derived bundle of rights and time-proven procedural requirements that shape any governmental process of judgment that may deprive an individual of life, liberty, or property. It is a threshold matter, not one factor in a series, as depicted in Shapiro's list of arguments. This means it predetermines what fairness will look like and binds equally all parties to a dispute to its prescribed standards.

But the concept of not judging a person on unproven allegations, even when the accusations start climbing in number, is a non-judicial justice and is due to all in a civilized culture. Geez. Put yourself in the accused shoes.

You can't constrain a voter's choice. A voter may use any benchmark he wishes when casting a ballot. Geez. Put yourself in a voter's shoes.

Shapiro is a never-Trumper. Shapiro was jealous of Milo because Milo impacted the college youth and got the media’s attention!

Shapiro is part of the GOPe establishment, uniparty.

His whole article is about due process, generated by the line that Shapiro wrongly says it is all about political issues.

There is a lot of mind bending going on and it’s all in plain sight.

Accusations should not be allowed to determine guilt. PERIOD. That is exactly where we are headed with these yowling cat women. ( Producing tears is suppose to close the case in their favor.)

The FACT remains, or should remain, that absence of evidence, witnesses and corroboration should still mean something in the USA. Anything less corrupts truth, due process and justice.

These women have nothing on Moore and don’t even pretend to have it, apparently, and the STATUTE OF LIMITATIONS is not a “concept” but a reasonable and justifiable determination of law that is being eroded.

I’m sorry, but our justice system “ain’t bad”, as they say, and Americans sometimes lose justice when their experience was real and true, dreadful, tragic, but still unprovable.

We are not perfect. But, imagine the multiplication of cheap accusations, especially political ones, that would take down a country.

Lawlessness is established when pointy fingers alone, with no evidence in sight, can nail YOU and make YOU guilty.

He’s a wimp in a crunch, but thinks intentionally losing is ok as long as you lose “honorably”.

Basically a bit too much George W, and Glen Beck still defines his paper thin tough guy persona.

He’s good commentary, but not a general.

This article is absolutely wrong and Shapiro is 100% right. Elections are political (not legal) events.

Shapiro is free to have his opinions.

My current attitude is that I'm not going to care what a politician does "off duty", as long as he votes in the direction I want him to.

I was humiliated and punished as a third grader in a case where due process was denied me in a classroom situation. Laugh if you will, but due process has a place outside the legal area.

Not to weigh in on the allegations, but remember the charges leveled against AK Sen. Ted Stevens which caused the loss of his seat and gave us (so far and likely permanent) Obamacare ?

Your position, if you had bothered to read Shapiro's article, is what Shapiro says is an "honest" position. Of course, he also describes it as disgusting.

We’ll... you haven’t seen any because there aren’t any. I disagree with Shapiro on Trump and on Moore, though he’s not one of the mindless guys from NRO that just savage Trump day and night. With Shapiro, I understand where he’s coming from... his views aren’t irrational; I just disagree. He’s what we need on our side; he’s a fighter. Knee capping him isn’t helpful to our side. The “anti-Christian” post you’re referring to is just a flat out lie. The notion that he’s spoken out against Moore because he’s a Christian is just... well, it’s stupid and not supported by the evidence, that’s what it is.

I guess in Hillary's case I did. Part of the reason I refused to vote for Hillary was because she mishandled classified information. She was never charged with that, but it did sway my opinion.
