California judge tosses $417 million talc cancer verdict against Johnson & Johnson

A California judge on Friday threw out a $417 million verdict against Johnson & Johnson in a lawsuit by a woman who claimed she developed ovarian cancer after using its talc-based products like Johnson’s Baby Powder for feminine hygiene.

The ruling by Los Angeles Superior Court Judge Maren Nelson marked the latest setback facing women and family members who accuse J&J of not adequately warning consumers about the cancer risks of its talc-based products.

The decision followed a jury’s decision in August to hit J&J with the largest verdict to date in the litigation, awarding California resident Eva Echeverria $70 million in compensatory damages and $347 million in punitive damages.

Nelson on Friday reversed the jury verdict and granted J&J’s request for a new trial. Nelson said the August trial was underpinned by errors and insufficient evidence on both sides, culminating in excessive damages. …

The judge added that there also had been misconduct of the jury during the trial.

J&J said declarations by two jurors after the trial showed that three members of the 12-person jury who voted against finding the company liable were improperly excluded from determining damages. …
Wonder if they can prevent these kind of shenanigans from happening if/when this goes to trial again.

Did you know that a frequent slippage area, ~20 years, of the San Andreas fault was targeted with many sensors to pinpoint the exact area, so that the next time it happened they could drill down and take core samples.

The slip was about 7 years or so late, but the core samples revealed that the fault occurred along a vein of the mineral used to make talcum powder.

I was wondering the same thing. I’m thinking it would be good for external areas for sweating and odor control, but I’m thinking most women would leave the door closed for such a product.

Proved or disproved means nothing in today’s civil suits.

Something bad happens to someone and lawyers want to make someone else pay, the deeper the pockets the better, regardless of whether that someone with deep pockets did anything wrong.

Juries are whipped into class warfare frenzy and hand down immoral verdicts.

There were reports 20 years ago at least that using talc products near women’s private parts could be drawn into the vagina and there were chemicals in talc that should not be taken internally.

The vagina acts as a vacuum and that is why some oopsie not quite there sexual relationships result in pregnancy.

What about us guys? We’ve used talcum powder in our groins and on our bodies to absorb the sweat when we are out doing hot and sweaty work! We should have gotten a share of the multi-million dollar finding....the decision was definitely sexist. And what about the chances of getting cancer from using foot powder while many of us older guys were in the military?

Most women shower daily and have no need for what this women was doing with it for so many years.

I wondered what the benefit was but decided that I really don’t care.

I found a product called “Monkey Butt” for my husband when he has to work the hot swampy summers here in South Carolina. Wearing jeans causes irritation.

It is talcum based. But it isn’t made to put into body cavities.
