I think the problem is that Hillary can depend on the complicit media to cry that a prosecution against her is a political hit job.
Also, we (the US) probably have more to lose from becoming a country like Ukraine, where the winners routinely put the losers in jail, and the country ends up with a system where the recriminations are endless, and almost everyone jockeying for power is deeply corrupt, than in letting a "Hillary" skate for a while.
It is also possible Trump expects Hillary to hang herself: She's already managed to do that at least partially, in a political sense, more than once.
