Justice Anthony Kennedy, the man who so often determines the outcome of the most controversial Supreme Court cases, is himself the center of brewing speculation. Will he stay or will he go?

The rumors have swirled for months and the 80-year-old justice has done nothing either personally or though intermediaries to set the record straight on whether he will step down.

Ruth Bader Ginsburg is in her mid 80’s and seems to be showing signs of dementia.

Are they going keep her propped up until she withers away into dust hoping that another democrat is someday elected president?

Maybe RBG will acknowledge that sleeping during sessions is not to the benefit of the Republic and will finally step down. She might try to hold on hoping for another Dem President to come along. But as the President's reelection continues to seem more probable, she must realize that she can't make it 7 more years.

“A Term of the Supreme Court begins, by statute, on the first Monday in October. Usually Court sessions continue until late June or early July.”

He will announce retirement on Monday and retire after the end of THIS session.

President Trump will have the recess time to nominate and get confirmed a new justice before the fall term.

BET ON IT!

The constitutional health of the federal courts is really what counts. It’s about the only reason I voted for Trump.

I believe they're seriously going to try to impeach Trump AND then Pence, hoping to have a Democrat Majority in the House in two years to install their own Speaker as the replacement president.

If they are going to retire and want a Republican to replace them then they should do it sooner than 2019 - although the map is against them, you should never just assume the Democrats would not win a majority in the Senate.

Trump would have to be re-elected in order to have the opportunity to replace Ginsburg and Breyer most likely.

It might be useful to see how many opinions Justice Kennedy has written in each of the past couple years.

A justice usually likes to hang on to his job until St. Peter himself has to render an opinion.

Yes, they are. You can bet this last decision Ginsburg wrote on behalf of the court the other day was not written by her. It was a timely and deliberate attempt to show the public that she's still functioning.

Under her sporadic direction, her law clerks and staff are doing the research, writing, etc. for decisions. I bet they LOVE the experience they're getting.

All she has to do these days is to go to work when she's up to it, nap in her office and show up for for hearings, arguments and votes....all of which she can do by working off of prepared notes and questions.

This flim-flam could go on for years.
