Gregg Jarrett: What is Robert Mueller investigating (since collusion is not a crime)?

Robert Mueller is tasked with finding a crime that does not exist in the law. It is a legal impossibility.

As special counsel, Mueller can engage in all manner of spectacular jurisprudential gymnastics. However, it will not change the fact that colluding with Russia is not, under America’s criminal codes, a crime. It’s just not there.

Maybe it should be. Perhaps someday Congress will pass a law criminalizing such conduct in political campaigns. But for now, there is not a single statute outlawing collaboration with a foreign government in a U.S. presidential election. Or any election, for that matter.

Why, then, are so many people who are following the Trump-Russia saga under the mistaken impression that collusion is a crime? Principally, because it is a loaded word with an historic criminal connotation.

I mean, I feel kind of sorry for Donald Trump. He’s gone into a hurricane with a parasol. He wanted the USA to unite, not for one wing to do its best to strangle the other into silence.

But this is a God sized job, not even a Trump sized one.

I've been here at FR long enough to see MoveOn.org screeching about President Trump's purported "obstruction of justice" - after wanting to "censure and move on" from Clinton's ACTUAL obstruction of justice.

And to see Dick "Less" Durbin accuse President Trump of "obstruction of justice" - after he voted "not guilty" when confronted with Clinton's ACTUAL obstruction of justice.

These people are hijackers, terrorists and seditionists.

Oh, Donald has plenty of enemies on both sides of the aisle.

If we have to evoke the image of an airplane, it is as though each wing took it as a mortal mission to nullify the other.

So is it a crime to unmask American citizens? To surveil them without warrant? To influence an investigation by meeting the boss on a tarmac?

Maybe Mueller (is that how his name is spelled?) can investigate these actions.

“Under the law granting him legal authority (28 CFR 600), a special counsel is charged with investigating crimes. Only crimes. Nothing else. He has limited jurisdiction. Any other wrongdoing uncovered in the investigation which does not rise to the level of a criminal offense cannot even be made public by the special counsel. That is the law.

So, a good starting point might be common street crime in one of DC's better neighborhoods at ten after four in the morning, to wit, two shots in the back, resulting in death in a DC hospital at 0557.

No discernible motive: the vic's wallet and phone were still on him, as well as a necklace valued at $2k.

Murder I, especially for hire, rises to the level of a criminal offense.

Watch your back, Greg Jarrett. Looks like the wives of the Murdock boys are out to get rid of anyone looking at situations which might be bad for the extreme left in the DNC. In the bigger picture, it looks as though these families who are much richer than anyone who has ever lived are out to set up a global dictatorship which will enslave the rest of humanity and technology has made that possible. Make no mistake, if that is afoot, violence and death is a danger for anyone who opposes. Sean Hannity is the latest victim of the Murdock’s. What a shame. We need courageous men and women who will stand as long as possible because this is not going to end the way the left plans.

Exactly right. Life as anyone knows it cannot go on under a burden of lies and propaganda and the Constitutional crisis we are coming under because of that situation in our government and media is very serious. The enemies of the US are within and I believe those enemies are afraid of Trump, not because they think he is “unfit” to be President, but, because (my opinion) of things he knows about which they have been covering up from the American people for far longer than we can imagine. When he began to use the “swamp” as a description of Washington D.C., he knew exactly what he was talking about and they are petrified of what he might know about how they have used their offices to dupe America which explains much of their behavior in their constant attempts to transfer their sins to Donald Trump.

The problem with these special counsels is that they always want to get a scalp, and they never stop until they do. Ken Starr was appointed to investigate the Clintons’ shady dealings with Whitewate, and yet Starr got Clinton on a process charge for lying about a completely unrelated event, having sex with an intern, that was far outside his original mandate.

Patrick Fitzgerald was appointed to find the leaker of Valerie Plame’s CIA employment. It turned out to be Richard Armitage, a Democrat. So instead he got Libby Scooter, a Republican, on a process charge for misremembering certain dates during a routine FBI interview - an interview that was not recorded, had no contemporaneous notes taken, and where the FBI agent when cross examined and was revealed to be just as confused as Libby was. And yet a DC jury convicted him anyway in what many legal experts thought was a travesty of justice.

It has never been shown that Nixon knew about the Watergate break-in in advance. (Historians agree he didn’t.) So Leon Jaworski got Nixon on a process charge for trying to protect Gordon Liddy.

Every single time these special counsels are unleashed they run amuck until they can tag someone with something. It us always a ‘gotcha’ related to the investigation itself, and never the actual original act that got them appointed in the first place.

And whatever charge Mueller can get will go before a DC jury where 91% of the citizens voted for Hillary and only 4% voted for Trump.
