Definitions:

Professional - (of a person) engaged in a specified activity as one’s main paid occupation rather than as a pastime.

Engineer - One who is trained or professionally engaged in a branch of engineering.

Professional Engineer (by logical extraction) - one who engages in a branch of engineering as their main paid occupation rather than as a pastime.

I work with a number of professional engineers. Some are government-licensed and some are not. But they are all professional engineers.

Of course, all this is irrelevant - the true issue here should be that the yellow lights are perhaps too short in comparison to the speeds at which traffic flows in specific locations. The government is using a club here to silence a citizen that has taken issue with that.

Each State has codes (state law) which define these terms.

Facilities and structures which require design for public safety, generally require the services of a professional engineer as defined within that State, to sign and seal the design documents.

Traffic controls on public streets would then likely require the signature and seals of a responsible professional engineer for their design.

Even for Federal facilities, which typically are built on State lands, they will fall under the jurisdiction of the State or local authority. Generally, the streets have to be designed per the State Traffic Codes and are generally AASHTO compliant.

There are lots of folk who work full time in construction and the trades, who perform subprofessional work and are not licensed nor registered as Professional Engineers. If they are neither registered nor licensed, then they are not Professional Engineers, and in most states are not allowed to use the title, without risk of violating State Codes.

Most building codes require drawings and specifications with PE signatures and stamps, to be kept at the job site at all times during construction, or else the work may be halted.

Simply having worked around engineering and performing some calculations as a full time job won’t qualify one as a PE.

In the interest of fairness, let's go back and review the facts at hand here (some of which come from other sources of information beyond the article at the top of this thread). This guy Jarlstrom and his lawyer have put together a narrative that is aimed at telling the following story:

1. Jarlstrom's wife got a ticket for running a red light. The ticket was issued through a red-light camera program implemented by the City of Beaverton.

2. Jarlstrom, who was educated as an engineer and works in a job that fits under a broad description of an "engineer" in his industry, went out and did his own research and prepared his own calculations that indicated the yellow interval at the traffic signal in question was too short based on standard traffic engineering principles.

3. Jarlstrom took it upon himself to complain about this. From the reports I've seen, Jarlstrom and his lawyer are very vague about how he went about with this complaint. They want you to believe that he simply wrote a letter or e-mail to the local newspaper or contacted the City of Beaverton -- as he has every right to do -- in an attempt to address his grievance.

4. Jarlstrom referred to himself as an "engineer" in his correspondence with one or more parties over this issue.

5. The Oregon State Board of Examiners for Engineering and Land Surveying -- in apparent response to his complaints -- took it upon themselves to sanction Jarlstrom and issue a civil penalty of $500 for allegedly practicing engineering in the State of Oregon without a professional license. This, contends Jarlstrom and his lawyer, is a blatant violation of his right to free speech.

Now lets look at the fact as they actually occurred. For the purpose of this discussion I'll assume that Items #1, #2 and #4 in the Jarlstrom narrative I've posted above are accurate. But let's go into some more detail about what REALLY happened here:

3A. Jarlstrom contacted the Oregon State Board of Examiners for Engineering and Land Surveying himself, in an attempt to have the board initiate disciplinary proceedings against the City of Beaverton engineers who signed and sealed the design for the traffic signal in question. In other words, Jarlstrom absolutely loved the "jackboots in a leftist controlled state gubbermint" when he wanted them to take action against one or more engineers who were licensed in the State of Oregon.

3B. Jarlstrom identified himself as an "engineer" in his correspondence with the Oregon State Board of Examiners for Engineering and Land Surveying, and used this description of his training and/or current occupation to support his claim that the City of Beaverton engineers should be subject to disciplinary proceedings.

5. The Oregon State Board of Examiners for Engineering and Land Surveying -- in response to his description of himself as an "engineer" in a matter in which he has filed a formal complaint on the basis of his own analysis, research, calculations, etc. against one or more individuals who ARE licensed engineers -- tells him that he has no legal standing to make such an accusation. Furthermore, his approach to addressing this matter is in direct violation of Oregon's laws and/or regulations that govern the practice of engineering in the state.

In other words, what Jarlstrom did here was the equivalent of a person with a B.S. degree who was a Pre-Med major filing a complaint with the state medical licensing board over an allegation of professional incompetence by a neurosurgeon ... and calling himself a "medical doctor" to support his complaint.

If I was the licensed engineer who was the target of Jarlstrom's complaint, I'd make him wish he only had to deal with a $500 civil penalty. He was completely out of line here.

Yellow lights too short? We have some lights here that change nearly before your vehicle moves. You are in the middle of the intersection when it turns red. It is very dangerous. Thankfully there isn’t a camera there.

That is true. Too many times I have had to sit through two or three light cycles to finally turn because the signals are way too short.
