Prosecutors have struggled with whether the First Amendment precluded the prosecution of Assange, but now believe they have found a way to move forward.

The first amendment was not intended to protect someone from prosecution if the crime committed was the cause of harm to others, including people and business entities and government entities.
A person does not have the right to yell fire in a crowded theater, and neither does he/she have the right to protection under the constitution, if that person had committed crimes detrimental to one's life, and in the case of Assange, hundreds and perhaps as many as millions of lives were put in danger via his "spying" operation. No one can hold up the first amendment in one hand, while pulling the "trigger" with the other hand.

Nonsense. Prosecute the effin leakers withing CIA, not the publisher of the leaks. And while were at it, shut down all the UNCONSTITUTIONAL DOMESTIC SPYING committed by the CIA and NSA and FBI
