It happened in 2006. Roberts was the new chief and he wanted to do something the "the waters"

They took the Rapanos case and it came out a 4-4-1 decision and Kennedy's position was difficult to interpret.

Consequently, there were many subsequent lower court decisions in conflict with many judges and numerous courts complaining about the chaos created by SCOTUS and their refusal to take another case and clarify.

Obama and his EPA did everybody a big favor when they rewrote the reg because that forced this case back into the lap if SCOTUS.
