How to Repeal and Replace ObamaCare ASAP

Even if the House passes The American Health Care Act [“AHCA”] next week, it must overcome what have been — falsely — portrayed as insurmountable Senatorial procedural hurdles.

One circuitous method to overcome them would necessitate the Vice President overruling the parliamentarian regarding compliance with budget reconciliation-based constraints, so that TrumpCare could include more features and adjustments to insurance mandates and other ObamaCare rules, and pass by a simple-majority.

It would be preferable to alter the Senate’s arcane rules, thereby neutralizing any such constraints.

From the GOP’s perspective, it is desirable to work backwards from the intended endpoint, namely, to eliminate the two major onerous components of Obamacare: the insurance mandates and the taxes.

To do so, it is necessary for all Republicans to unify behind recognition that a “Phase III” in Speaker Ryan’s 3 phase approach — budget reconcilation that requires 51 Senate votes, issuance of new HHS rules by HHS Secretary Tom Price, and then new legislation requiring 60 votes — may never be reached, due to inability to overcome a 60-vote Senatorial threshold for Phase III absent any Democrat support.

Therefore, Phase I must encompass all that the conservatives want in a putative Phase III by insertion of a Manager’s Amendment introduced by Speaker Paul Ryan.

I’m deeply concerned that the “replacement” would be _owned_ by the Right, like it or not, and vilified & attacked by the Left relentlessly & mercilessly until they can replace it with single-payer. ANY “replacement” _will_fail_, and do so with the intention of taking the Right with it.

We don’t want a replacement.

We can’t afford to be tied to something which is un-Constitutional to begin with.

We want the government OUT of the healthcare business. Some regulation is reasonable to prevent gratuitous problems, as a matter of “interstate commerce” issues and “public welfare” problem-prevention - but that would require _allowing_ “interstate commerce” to begin with (inexplicably banned now), and there’s a systemic misinterpretation of “welfare” as “redistribute” instead of “do no harm”.

NO REPLACEMENT.
REPEAL ONLY, AND FIX THE OBVIOUS OBSTACLES.

The GOP has repeatedly claimed partial victory by Congress (both, or just House?) passing a repeal. Can’t we just repeat that? WTF doesn’t the Right just do it for real this time?

This silliness was already shot down. Ignoring the Parliamentarian equates to killing the Filibuster and conservative Senators are not going to support that, for excellent reason.

So this article is safely ignored.

Because those repeal votes were not opposed by the Dems since they knew Obama would never sign the bill. They just didn’t waste time on it.

All of this stuff has already been covered. Ignoring the Parliamentarian is killing the Filibuster and conservatives won’t support that, let alone moderates.

And “we already had repeal votes” was because the Dems didn’t bother to filibuster it. They just voted no. A filibuster would kill that and you need 60 votes to cloture a filibuster.

This is all getting repetitive. It’s already been covered. If you want to improve the bill, then improve it. Some improvements are already being installed.

They will abolish it overnight.

The federal government issues Article I Section 8 patents for drugs.

The federal government is in the medical business and can’t get out for at least 20 years - the length of a patent.

People need those drugs to survive. The drugs are expensive because of the federal government patents.

It has become “necessary and proper” for the federal government to prop up the health insurance system that pays for these drugs and to bar exclusions for pre-existing conditions that require these drugs.

There is about a $250 billion annual cost for the Article I Section 8 drug patents, about 40% via the PPACA and about 60% through Medicare Part D.

Yes, Article I Section 8 drug patents will cost the average American family of four about $2,800/year - and save lives too.

Question : if Ocare is repealed immediately, what happens to those with ongoing health problems and those currently in lengthy hospital stays?

Everybody seems to be giving us a false choice: Repeal or repeal and replace. With either of these two choices, *someone* is going to lose and the left will make a huge deal out of it.
A better option is to leave Obama care in place but remove the mandates and penalties. At the same time, open up the free market and let people buy whatever they want. That way, people who want to stay with Obamacare can, and we won’t get blamed for taking it away from them. Meanwhile, Obama will collapse on it’s own but there will be other cost-effective and better options available because of the free-market.
So I say, don’t repeal it. Repeal the mandates. People will leave Obamacare themselves.

Insurance is by contract. The contractual coverage will continue if the premiums are paid.

Can subsidies by yanked? Subsidy yanking might be considered an unconstitutional ex-post facto law. Lawyers would know more.

Of course, Social Security can be yanked without notice, so maybe subsidies could too.

Hence the importance of the “let Obamacare crash and burn” strategy. Let it repeal itself. Submit funding bills that don’t fund it. Quit playing nice when the Left is slashing at the GOP’s jugular. Stop trying to pass a replacement, we don’t want it. Don’t ask for a repeal. Repeal by killing it, if the Left won’t agree to a straight fair majority vote.

I still say that if it is at all possible, make ALL get in the program.

All those now exempted should be put in the program - Pols, unions etc etc etc.

Just tell them NOTHING will change but now you are involved.

There will be changes swiftly.

Like the one person had said that all PDT has to do in the exemptions for travel is ban EVERYONE since the only hang up seems to be ‘they’ think the Muslims are being singled out.

That dictionary and plays on words should be able to work for both sides, ‘WE’ allow only the Libs to do it now.
