House Republicans and the Trump administration on Tuesday filed a joint motion seeking to delay lawsuit proceedings that threaten to undo President Barack Obama's health care law, the Affordable Care Act.
The House v. Price suit formerly known as House v. Burwell, as it was filed when Sylvia Mathews Burwell was health and human services secretary has presented Republicans with one of their most straightforward routes toward fulfilling their stated desire to do away with or dismantle Obamacare.

The lawsuit, first filed by House Republicans against the Obama administration in 2014, challenged whether the administration legally allocated billions of dollars in funding to health insurance companies to help low-income people pay for out-of-pocket medical expenses. A federal judge sided with the lawmakers in the case, but the funds continued to be allocated as the Obama administration appealed.

A repeal plan should have been on Trump's desk on Day #1. Don't worry about replacing it - that's the Left's tactic at getting Republicans to adopt something similar, or worse than Obamacare.
Just repeal the damn thing. If Republicans DON'T repeal Obamacare, or adopt something similar, they are going to LOSE Congress.

I can only hope they asked this because they don’t want this to screw up a better solution. but I’m at a loss to understand why we would not simply want the stay removed.

This is President Trump’s chance to make me very displeased. His two non-negotiable promises were deporting illegals and repealing Obamacare. I hope this is just more fake news, or out of context.

I’ve getting a little concerned that the entire US government has a “too big to fail” attitude about Obamacare and are just trying to find a face saving way to do a shell game on us.
Could be they want Scala’s seat filled first.
Potentially given a gift by the courts (very rare) and they don’t take it?! Perfect chance to move forward in repealing O-care and no, the RINO’s & GOPe are MIA again. And Mr. Trump’s “replace” mantra is clouding his judgement. Giving Mr. Trump 100 days to repeal the ACA or I am going to be a harsh critic.
That’s my best guess, too. And if they’re lucky, Breyer or Ginsburg may retire as well.

I agree with this; the one tactical mistake I see Trump making is that he is starting doing some of his actions without (1) getting Session in as AG; and (2) filling the Scalia seat. Both are critical in terms of Trump’s actions having a shot at being upheld. Otherwise, the lefties will forum shop to get a liberal judge in a liberal circuit to stay Trump’s actions, and then there will be a 4/4 deadlock at the Supreme Court.
The way I read it, the delay is to give Trump and the rest time to get all their ducks in a row instead of having a case being ruled on that may complicate things for them. Which court would hear ti first and what progression up-line?
Yes! The Supreme Court, right now is too risky. We need to have Gorsuch in place for a number of reasons.
