If the 9th Circuit were split into two or three smaller circuits, each would still have the same numbers of citizens per circuit as the nation's average circuit.
The 1st Circuit covers 14 million, the 10th circuit 17 million, and the overall average is 28 million per circuit.
The 9th circuit is the largest with 61 million.
All told, there are 179 authorized circuit judges (18 now vacant) with 1.7 million people per judge.

This map is as of 2015 and somewhat hides the Democrat majorities on most circuit courts.
The actual numbers are probably today still pretty much as you see here:

Samurai_Jack: "The law is on the administrations side here.
My instinct is that this inoculates them against the inevitable terrorist attack."

Bingo! We have a winner, folks.
I think you've nailed it, this is exactly what's going on.

Personally. I want to see the Federal Marshals arresting these ‘judges’ as accessories to any terrorist attack committed by people this executive order would have kept out.

It is LONG past time that Judges be held responsible for their irresponsible decisions. Would that have a ‘chilling’ effect on the court systems; you bet your booty it would.

The question is...how do you impeach a Judge that is, for all intents and purposes, trying to redefine the Constitution through judicial activism? Overreach is a polite word for judicial sedition.

A reasonable response is to leave the West to its fate, hope for the best, and build elsewhere.

There is no elsewhere. That's why this fight is so important to win here and now.

I am wondering if President Trump goaded them into this ruling to then get the Supreme Court to smack them down?

Nonsense! The judges are free to make up their own minds about any issue, and they did. The trend of federal judges making international laws and concerns supreme over the United States Constitution and laws has been building for a long time, so their ruling was entirely predictable. Even little old non-lawyer me predicted it easily.

Suddenly the media will go silent about the previous days headlines. But DJT with his Twitter Machine will go NUTS!!

I'm thinking that these activist judges are hoping for a big attack, because it would help their narrative: Donald Trump did squat to protect the country, he is illegitimate, he failed in his Constitutional duties. And the fact that he issued an EO to prevent people from known incubators of terrorism from entering the US will be twisted; the propaganda media will spin that it was horribly flawed and would not have prevented any terror attack.

Do not underestimate the ability of the media to turn any event into communist propaganda that advances their cause. Do not underestimate their desire to make the US into a third-world hellhole.

Well said.

I voted Trump because he put my kids life above some immigrants desire to leave an Islamic shit hole and start a new islamic shit hole, here, in my backyard. These three judges have put my kids lives in danger. They have trampled over the constitution.

The Trump Administration could easily rip up this order and create another, and another and another ad infinitum.

That would be like a hamster running in its spinning wheel. The hamster gets nowhere about as fast as it can go.

We are not hamsters. At some point we have to make a stand against what the federal judiciary has been doing to our nation since at least the Warren court. President Trump is willing to make that stand. The least we can do is stand with him.

Excuse my ignorance of US law. What would prevent the Administration from bringing this to a judge in a more friendly Circuit? Competing decisions would eventually have to go to the USSC but it would water down the scope of the loony 9th?

Yup, the women they bring in with little kids are just time bombs. In 10 years, we will see their children slaughtering people all over the country. They are religiously obligated to slaughter people.

> This is evidence of a "Muslim ban"?

It's a terrorist ban to protect U.S. citizens from a group of people who just happen to have committed almost all of the horrific or the majority of terrorist acts. That they are almost always Muslim and teach their children to shoot weapons in their youth and blow themselves up is eerily coincidental..../s

Best course of action at this point, now that the new AG is on board, is to get the sharpest available legal minds together and craft a substitute order that will address the specific exceptions and substitute it for the one that was blocked. That’d be the most expedient work-around.

constitutional rights of Americans, that only Americans are persons in the United States

Beware of fake logic. RIGHTS come from God/Natural Law. As such, every person in the world has RIGHTS. The right to Life, the right to freedom of speech, press, religion, bear arms, etc.

The current court case is not about RIGHTS. It is about PRIVILEGES. It is a privilege to live in the USA, not a right. It is a privilege for a non-citizen to travel to the USA, not a right.

The 14th Amendment defines citizen so it can state that Equal Protection of the Law and Privileges apply to all citizens as defined in the 14th Amendment. The 14th specifically excludes non-citizens.

They can’t abide by this. They have to do what they want, the courts have 0 standing. Once it gets to the Supremes it ‘ll be cleared though.
